The current legislation does which allows for organ donations with explicit concent of the donor leaves many in need of organ transplant without one as a many do not form an opinion on the matter or for some other reason do not explicitly give consent while they actually would be ready to give their organs to patients in need after they themselves have passed on. The current system rests on the principle that if the will of the patient is not known, it is assumed to be against donating organs. While this has been reasonable when organ transplantation was rare, and consequently the demand for organs was low, it has ceased to be so in current conditions with an ever increasing portion of the population requiring replacement organs to restore some degree of quality of life or to continue living at all. As many religious or other reasons may lead potential donors to oppose donating their organs we must leave the citizens a right to choose whether they want to donate their organs. To combine the personal right to decide on the organ transplantation while safeguarding the public interest in increasing the supply of organs to help increasing numbers of patients in need of them we propose a correction in the assumption as regards to personal consent. The modification is very slight, but it allows for a major increase in the amount of transplantable organs as many people willing to donate organs do not currentluy have sufficient foresight to give their consent while they can. |
