We believe that instituting a cap on the monetary damages awarded to patients will ensure the patients are able to receive compensation for their injuries while also attempting to minimize frivolous lawsuits. We believe that this policy is more effective than any other option available to us at this time.

If we were to make the doctor or facility in question responsible for only the legal and medical expenses, patients who have been injured, possibly for life, will be less productive in society and are likely to fall into the trap of poverty, government assistance and possibly illicit activity to sustain themselves. Thus, this system would be flawed and have a negative effect on society overall. If a capped settlement was approved through this bill, patients would be able to have the means to support themselves after their expenses are paid.

If we were to only allow lawsuits that force the defendant to revise their actions, then we would be putting an unnecessary burden on the plaintiff and abandon those who are victims of treatment so poor that they are unable to be revised. As with the last option, these people are even more likely to fall into poverty and vice in light of their lack of compensation.

We recognize that some parties may believe that even a capped settlement is just too much on doctors and facilities and may not support this bill because it doesn't go far enough. We will have to disagree, as we see this bill as ideal to balance the needs of the medical industry for profit at all levels as well as maintaining protection for patients who have been personally damaged by this industry.
