Description[?]:

A bill to establish special guidelines and penalties to prosecute offenders, and provide assistance to the victims of the heinous act of perpetrating sexual, physical, emotional or psychological abuse against a member of ones family, especially in the case of children and the elderly.

Article I: Domestic Violence shall be legally defined as violent sexual, physical, emotional or psychological behavior perpetrated against a member of ones home. This encompasses abuse of a spouse, parent, child or elder.

Article II: The Ministry of Health and Social Services, in cooperation with the Ministry of Education and Culture shall establish an agency called the Domestic Violence Response Task Force. The responsibilities of this task force will be as follows:
A.) To work with Law Enforcement in building cases against perpetrators of Domestic Violence.
B.) To provide comprehensive assistance to victims including counseling services, rape response services, emergency shelter during times of crisis, and adequate protection from future abuse and violence.
C.) To work in public and private schools to identify cases of Child Abuse; all schools will be required to have at least one Social Worker assigned at all times trained in identifying cases of abuse.
D.) To establish national Sexual Violence campaigns to educate the public on issues of Sexual Violence.
E.) To work in Elderly homes, Convalescent homes, and Orphanages in an oversight capacity to watch for cases of abuse.

Article III: All Employees of the Federal Government of Hutori will be hereby required by law to report all cases of Domestic Abuse against Children, the Mentally Ill, and the Elderly to Social Services or Law Enforcement.

Article IV: Legal Age of Consent to engage in sexual activity: people can legally make the decision to consent to sexual activity starting at the age of 13. Those under the age of 16 may only engage in sexual activity with partners that are within 5 years of their age (i.e. 15 year old can consent to anyone between 13 and 20 years of age).

Article V: When engaging in sexual activity, consent must be affirmatively given by all parties involved. Consent can be taken back at any time during the course of sexual engagement, in which case the other party would have to stop. Failure to disengage in sexual activity after consent has been retracted is considered rape and is prosecutable by law. Consent cannot be given while asleep, intoxicated or incapacitated.

Article VI: The Ministry of Health and Social Services is instructed to establish secure emergency shelters for victims of Domestic Violence in every municipality within Hutori.

Article VII: The penalty for conviction of rape shall be a minimum of 25 years of incarceration. The minimum penalty for physical Domestic Violence shall be 15 years of incarceration.

Article VIII: The Ministry of Justice shall establish a National Sex Offender Database, accessible to all employers, Governmental Institutions within Hutori, and foreign Governmental Institutions.
