OOC: change the name of the nation to the " Al-Jumhūrīyah Jakania (Republic of Jakania)" Preamble: The people, and leaders of Jakania, seeking to develop a stable environment for general peace and prosperity do establish this Basic Law as the fundamental constitution and governing document for the Republic. Article I: House of Representatives Section 1. The House of Representatives will be the supreme law making body of the Republic and represent the interests of the people. Section 2. The House will consist of 475 representatives elected at least every five years. It will be headed by a Speaker who will be elected at the start of every session and shall be assisted in attending to the duties of the House with such other officers as the House may establish. Section 3. When passing laws, the House shall need only a majority of votes of those present but for laws raising taxes and customs which will require a majority of the total representatives in the House. Section 4. It shall take a 2/3 majority vote in the House to approve treaties and to amend this Basic Law. Article II: President of the Republic Section 1. The President of the Republic is the supreme executive of the country, charged with upholding the laws of the Republic. Section 2. The President shall be the commander in chief of the armed forces and responsible for protecting the territorial integrity, national security, and internal stability of the Republic. Section 3. The President shall appoint his own ministers subject to majority confirmation from the House of Representatives. Section 4. The President shall appoint all government ministers, judges, ambassadors, generals, and other government and military officers to all offices and trusts established by the President or the House. Section 5. As chief executive and head of state, the President shall perform all related functions concurrent with those duties including the dispatching and receiving of ambassadors and embassies. Section 6. On the recommendation of the Minister of Justice, the President shall issue pardons and commutations of sentences with the concurrence and approval of a majority of the Council of Ministers. Article III: Council of Ministers Section 1. The Council of Ministers will be the main deliberative body of the government ministers which shall meet from time to time to advise the President of the Republic. It shall be chaired by the Prime Minister who shall handle the day to day affairs of the government and public administration. Section 2. The Council shall consist of the following members: -Prime Minister -Minister of Foreign Affairs -Minister of Internal Affairs -Minister of Finance -Minister of Defense -Minister of Justice -Minister of Infrastructure and Transport -Minister of Health and Social Services -Minister of Education and Culture -Minister of Science and Technology -Minister of Food and Agriculture -Minister of Environment and Tourism -Minister of Trade and Industry Section 3. The Minister of Finance shall be responsible for presenting the National Budget and all appropriations bills to the House for a vote of confidence on the subject. Section 4. The Minister of Defense shall advise the President and the Council on matters relating to the national security of Jakania and shall direct the Armed Forces of Jakania in a manner consistent with the orders set forth by the President. Section 5. The Council of Ministers shall be nominated by the President and confirmed by the House. Article IV: Constitutional Court of Jakania and the Lower Courts Section 1. All judicial power shall be vested in the Constitutional Court and those Lower Courts established by the House, this Law, and the governorates. Section 2. The Constitutional Court shall consist of 13 judges and a chief judge nominated by the President and confirmed by the House for life terms. The Court shall handle all issues pertaining to the Basic Law, international treaties, and other high constitutional affairs and shall have both original and appellate jurisdiction. Section 3. The Chief Judge of the Court is the responsible official for ensuring the fairness, and impartiality of the National Judicial System. Section 4. The second lowest court shall be the Supreme Court of Appeals, which will be the highest appellate court and have only appellate jurisdiction from lower courts. It shall take all cases when there is cause that the lower court shall have improperly handled the case. Section 5. Each Governorate shall have a High Court which shall be both a provincial and national court. The High Court shall consist of an appropriate number of judges with each High Court having a Head Judge who will oversee the workings of each Court. It will be the highest provincial based appellate court and the primary court for all national crimes and cases. Article V: Governorates and Local Affairs Section 1. There shall be 5 basic governorates in the Republic. Section 2. Each Governorate shall be headed by a Governor, appointed by the President and they shall be from the Governorate in question. Section 3. Each governorate shall be responsible for the administration of local law, governance, and order and shall have appropriate duties as defined by the House. Section 4. Each city and metropolitan area shall be headed by a Mayor, appointed by the President, and a resident of said city. Each Mayor will be advised by an elected Citizen's Advisory Council which will consist of 25 members who will advise the Mayor on local administration. Article VI: Rights of Citizens Section 1. Each citizens shall have an uninterrupted right to exercise their vote and participate in the political process unless convicted of treason, high crimes and misdemeanors against the Republic, or engage in other seditious activity against the Republic. Section 2. The right to peacefully assemble, and demonstrate shall be protected to the fullest extent of the law excepting in cases of public emergency, riot, general public disorder and other such causes which would endanger the stability of the Republic. Section 3. The right to free speech, a free press, and to petition the government shall be protected. Section 4. All citizens shall have the right to a fair, public trial and the protections of due process of law. Section 5. The House shall make all legislation for the protection of the rights of citizens, and all laws concerning, immigration, naturalization, and citizenship. |
