| With the aim of establishing a permanent, professional, and accountable intelligence agency, the Assembly hereby establishes the Kalistani Republican Security Bureau, as part of the Foreign Ministry. The Director will be appointed by the Foreign Minister. The Director of the Bureau will report directly to the Foreign Minister, who will include an annual summary of all intelligence activities in the Ministry Report. The Assembly shall have the power of oversight for all intelligence activities authorized by the Foreign Minister, with the exception of those deemed of highest national security, which would be detrimental to ongoing activities if reported out in the Assembly and in the press. The President of the Republic will also be entitled to be fully appraised of all ongoing intelligence activities at any time, and may require activities to be begun or ended. The Bureau will only conduct intelligence activities in accord with Kalistani Law. The Bureau may conduct no activities, surveillance or intelligence gathering within the National Territory of Kalistan, nor may it ever target a citizen of the Imperial Republic of Kalistan with any program. The Bureau shall be limited to passive intelligence activities in countries with whom Kalistan has a treaty of friendship. For all other nations, the full range of legal intelligence activities shall be authorized, to include: * Gathering of intelligence on subjects, * Building and maintaining sources of human and electronic intelligence, * Gathering any and all material on economic activities of various states, * Gathering intelligence on various non-state actors within a state, * Infiltration into state and non-state agencies and organizations for the purpose of intelligence gathering, and in limited cases, * Espionage (defined as acquiring and transmitting secrets to Kalistan) * Sabotage (defined as destruction of some physical object or information) * Influencing foreign election outcomes, * Targeted assassination * Detention of individuals * Providing materiel support to those who are advancing Kalistani interests in foreign nations * Limited demolition for the purpose of accomplishment of political outcomes and * Fomenting disorder and revolt for the purpose of accomplishment of political and economic outcomes. The use of torture or anything which could possibly be construed by a reasonable person as torture, is expressively forbidden by this Law. Additionally, the Bureau is expressly forbidden to injure, even accidentally, by some direct action, civilians of foreign states on foreign soil, who are not deemed legitimate political or economic targets. In all cases, where a civilian will be injured, the Bureau must be able to explain why the target is construed as a legitimate political or economic target. Officials of foreign governments and firms are explicitly excluded from this restriction. The Bureau shall be granted a budget necessary to acquire and maintain any and all surveillance equipment and material, to include weapons, ammunition, transportation and human assets, necessary to carry out the foregoing powers. All expenses and programs will sunset after 3 years and the Bureau must request new funding for ongoing operations or cancel the program all together. The mission of the Bureau, as well as all programs pursued by the Bureau, shall conform to the National Interests of the Imperial Republic of Kalistan, as determined by the President of the Republic, the Prime Minister of the Assembly, and the Foreign Minister of Kalistan. Additionally, the Bureau will work in conjunction with other ministries, as well as other state non-governmental organizations in the determination of auxiliary interests. The Bureau will have access to unleased portions of the Kalistani Auxiliary Navy for the purposes of transit and materiel transport, but otherwise will use non-Bureau commercial assets. This bill will be passed into law with a simple majority, and may be repealed by the same margin. As long as it remains in effect, it will be listed in the RP House Rules list of Kalistan. |
