SECTION A. PURPOSE. The purpose of this Act is to provide for a procedure for the various Ministries to promulgate rules and regulations toward the implementation and enforcement of existing laws. The various Ministries shall follow the procedures as outlined below.

SECTION B. DEFINITIONS..
(i) Aggrieved Party. An aggrieved party is anyone who is substantially impacted by a rule or regulation promulgated under this Act.
(ii) Minister. Minister shall refer to the top official tasked with the administration of a Ministry.
(iii) Person. Person shall only mean a natural born person and shall not include a corporation.
(iv) Corporation. Corporation means a partnership, sole proprietorship, limited liablilty company, or a corporation.
(v) Rule or Regulation. A rule or regulation is one promulgated under this Act. Orders issued by a Minister with regard to his inherent powers (ooc: listed on the cabinet page) do not constitute a rule or regulation under this Act.

SECTION C. GRANT OF POWER. A ministry shall have the power and duty to promulgate rules or regulations only where there is express authorization do so or if directed by the Legislature or Executive Branch to do so. A rule or regulation promulgated without statutory or executive authorization or order will be deemed null and void.

SECTION D. PROCEDURE. A ministry shall follow the procedure laid out in Section 4 (a)-(
(a) Public Notice. When initiating the procedures to promulgate a rule or regulation under this Act, the Ministry shall publish a notice in the newspapers of general circulation alerting interested parties of the proposed rule and the upcoming public hearing.
(b) Public Hearing. A public hearing shall be held for atleast four months and ample opportunity shall be given to interested parties to provide comment on the proposed rule. The ministry shall take into consideration these comments and modify the rule or regulation as it deems fit.
(c) Implementation. After Notice and Hearing, the ministry shall submit the rule or regulation to the Governor for Archival purposes in the Code of Ministerial Regulations.
(d) Enforcement. A ministry shall have the right to impose fines, grant or revoke licenses, or pursue legal action in the Ministerial Courts against a party in violation of a rule or regulation. The ministry shall file a request for hearing to the Ministry of Justice.
(e) Appeals. If an aggrieved person finds that the ministry committed an error of law or acted arbitrarily or capriciously, that person shall have the right to appeal the legitimacy of a rule or regulation or enforcement action to the Ministerial Courts by filing a request with the Ministry of Justice.

SECTION E. LIMITATIONS. A ministry shall not promulgate a rule or regulation which is contrary to the existing law that it seeks to implement and enforce. If a rule or regulation is promulgated and conflicts with the existing law that it is created under, then it is subject to challenge in the Ministerial Courts.
