| Message | Mr Benn, this decision was not an easy one. There were several mitigating and aggregating factors in this case so this sentencing has been difficult to pass. But I have now made my decision. Minimum sentence I can give you is 15 Years Imprisonment with Parole at 7.5 Years. Maximum sentence I can give you is Death. Mr Benn, you operated a large illegal paramilitary on a national scale. Something our nation utterly condemns. However I do accept that this was in a time when terrorism was a serious threat and the paramilitary was formed for defence reasons. However Mr Benn, you did also claim that you were fighting on multiple fronts, however I do realise that they were 'small battles'. The result of your actions Mr Benn has utterly lead to casualties and deaths, today I am not going to give you the death penalty, nor am I going to give you life. This is because the jury were hung in their decision and I feel that your actions do not warrant your death. That is why I am giving you the following sentence: 20 Years Imprisonment, with a minimum of 10 years to be spent in custody. However I am deducting 1.5 years from your sentence due to time spent in custody during this case. Therefore your sentence is 18.5 Years Imprisonment with a minimum of 8.75 years to be spent in custody. During your sentence outside of custody you will be monitored using an electronic tag and i shall require you to engage in weekly meetings with the prohibition officer.
