MessageI'm opposed. while I understand and am sympathetic to the utilitarian sentiment of this bill, I am generally opposed to the presumption that someone's property is bequeathed upon their death without testamentary intention having been positively stated by the deceased.

MessageSomething tells me our voting records are going to diverge markedly. The way I see it organ donation is a wonderful public good, and can tend to save many lives. When there is such a social gain to be had, I don't think that the generally questionable idea that you have a property interest after you die -- example, can you say that the worms have eaten your property when they start goin' at you? -- should create a presumptive barrier against social gains.

MessageI see this as no different as the Soviet ideal that presumed that all of a person's property vested in the state upon the death of a person. I see it as a dangerous precedent. If the state or anyone else wants something from the individual, they should get express consent.

Some religions don't allow spending organs.
Therefore to change this law now will only lead to religious conflicts and disharmony in Selucia.

Messagethere's no conflict there - it is an easy opt-out -- if you don't want your organs donated just tell someone 'I don't want my organs donated.' Done and done. No property being given to the Soviets, no religious disharmony.

MessageBut if something belongs to someone, I believe that in order to respect that person's ownership, positive consent ought to be obtained. Presumed consent, in my view, is an unreasonable violation, in spite of the public good that presumed consent may theoretically bring.

Don't get me wrong - I applaud organ donation, I've signed my RL organ card, I've told my wife to let the proper authorities "strip me for parts" taking whatever they need. I sympathise with the sentiment of this bill. However, I think the state ought to be more respectful of the integrity of the individual, and should obtain positive consent.
