This bill asks for an amendment to the Constitution. It will require two-thirds of the legislature to vote in favor. This bill will not pass any sooner than the deadline. Baltusia's highest offices are worthy of the highest honors. Thus the positions must be respected as such. We propose an amendment to our constitution regarding the requirements to run or be appointed in the highest positions of the public office of Baltusia, and their public responsibilities. Article 1: On the Requirements for taking oath into a State Office: The President, Members of the Cabinet and State Governors must be at least 35 years old to take oath into office. Members of Congress, Mayors and the rest of the state officials must be at least 18 years old at the time of the oath, not necessarily the age of adulthood stated by our legislation (it can be the same age). The President of Baltusia must have been born in Baltusian Soil, in Baltusian Diplomatic Missions, Baltusian Waters or an official Baltusian Ship. The President of Baltusia, Members of the Cabinet, State Governors, Members of Congress, and all State Officials must be Baltusian Citizens at the time of the oath. Article 2: The President of Baltusia, Members of the Cabinet and State Governors, can be impeached and asked for their destitution after being accused of a serious constitutional offense. This Impeachment Request must be formally presented to the Congress, where the case must be thoroughly presented. The Impeachment will be granted with a 2/3rd plus one majority in the congress. Article 3: The President of Baltusia can present his resignation to his charge. This resignation must be approved by the 50% of Members of the Congress. Members of the Cabinet, State Governors and the rest of the State Officials can freely present their resignation to their superior. Article 4: If a President is impeached, unable to continue his duties or dead, the congress must approve to call early elections as soon as possible. The Ministry of Internal Affairs will take the position until these elections, with the formal name of the Vicepresident of Baltusia. Article 4 bis: If the Ministry of Internal Affairs is not available to fulfill the position, the position will be taken by the following line of succession: Minister for Foreign Affairs, Finance, Defence, Justice, Infrastructure and Transport, Health and Social Services, Education and Culture, Science and Technology, Food and Agriculture, Environment and Tourism, Trade and Industry, Constitutional Affairs, President of The Supreme Court, Leader of the Congress Majority, the State Governors (by Alphabetic order) and City Mayors (by alphabetic order). FINAL ARTICLE: If approved, this bill will take effect the January the 1st of 4169. If any State Official doesn't meet the requirements previously stated by that day, they will be forced to resign their position. Signed, Sen. Message | On a other point, this bill mention Mayors, but we don't have agreement on who are elected Mayors in each cities. ShouldN't we have presented a way to elect the mayors on cities, before this And mayors are not always elected. We have an option to have the local government elect the mayor in the constitution, I suggest the mayors may removed, ON other charge, the president should remain at his post until he is remplaced, the minister of internals is a busy minister, someone will need to remplace the minister who left to remplace the president. Message | On the first point, we understand. Yet removing the Mayors of the list of succession could leave a constitutional loophole in the, really unlikely event of having that whole list vacant. We can see that point later. On the other point, if the president's dead he can't remain at his post until his replacement is found, for obvious reasons. In that article it's stated that the President's impeachment (destitution) and its inability to continue his duties are equated to its death, because they need to be seen just as serious. An impeached president cannot remain at his position! not even a day after the vote! A Minister of Interior will be able to manage both positions for a few weeks, as the Early Election will be their primal objective then. I could re draft this, changing the Jus Solis requirement to a Jus Sanguinis if that's what the rest of the rest of the Congress think. Thanks for the feedback! |

ON the line of succession, we proposed that that minister of interior get remplaced, because being leading the police is not an easy task,, but that is not a serious objection. Our most serious objection are Article on president. We have presentation an amendement to this amendement, We'd also like to debate the possible of a foreigner who have become a Baltusian citizen to be president. |
