This constitutional amendment sets out the duties, responsibilities and prerogatives of the President of Zardugal, the elected head of state.

Article 1- The Prezidento de la Respubliko (referred to as The President within this bill) is the democratically-elected Head of State of the Respubliko de Zardugalo (referred to henceforth as Zardugal). The president holds office for up to six years (72 months) and can be elected for a maximum of two terms. Unless a candidate runs unopposed the president is directly elected by the people of Zardugal.

Article 2 - The President's primary role is to uphold and be a guardian of the constitution and act as a representative of Zardugal both domestically and overseas. The president's role is largely ceremonial - as executive power is vested in the government and the cabinet. As such the president carries out his/her functions in accordance with the constitution or on the advice of the government.

Article 3 - The duties of The President are:

a) To formally appoint the Statministro de la Respubliko (Chief Minister of the Republic). However, The President is required to appoint whomever the Respubliko Assembleo (Republic Assembly) designates without the right to decline appointment. The remainder of the cabinet is appointed by the nomination of the Chief Minister and the approval of the majority of Assembly members.

b) The President formally appoints the judiciary to all the courts of the nation, on the advice of the government.

c) The President formally signs all bills passed by the Republic Assembly into law. The President does not have the power of veto, however the President does have the right to advice the Government and Assembly if he/she believes a bill may be unconstitutional. This advice may be used by the government to repeal the bill, or propose an amended bill. But it must be noted that the government is not obliged to follow this advice.

d) The President represents the state in foreign affairs but only exercises this power on the advice of the Government. These responsibilities include approving ambassadorial appointments to represent Zardic interests overseas and to formally recognise the legitimacy of foreign diplomats. Furthermore, all international treaties Zardugal enters into are signed in the President's name.

e) The President is nominal Commander-in-Chief of the Zardic armed forces - the powers of which are exercised on the advice of the government. The President formally signs and seals officer commissions. In addition, declarations of war - which can only be approved with a 2/3rds majority in the Assembly - are signed in the President's name.


Article 4 - In the event of the President being unable to fulfil his/her duties, or in the case of the temporary/permanent absence of the President from office, the Chief Minister of the Republic will take on the role and full responsibilities of Head of State. This situation will remain in place until the President returns to duty - e.g from illness or injury - or until an election takes place to elect a new Head of State. During this temporary dual-role period, the Chief Minister will be formally referred to as President and Chief Minister of the Republic.

Article 5 - This bill asks for an amendment to the Constitution. It will require two-thirds of the legislature to vote in favour.
