This Bill is Designed to Define the Executive Authorities of the Executive Branch of the Federal Republic of Hutori Article I.) THE PRESIDENT Section 1.) The President of the Federal Republic of Hutori is the Chief Executive of the Republic and its ultimate defender of the Constitution Section 2.) The President is Commander in Chief of the Armed Forces and may Issue Orders and Deployments without permission of the National Senate, but Such Orders can be overturned by a simple majority vote of the National Senate Section 3.) The President is the Chief Diplomat of the Federal Republic and may seek diplomatic relations and Treaties with foreign nations. Any Treaties or Agreements negotiated by the President must be confirmed by the National Senate Section 4.) The President may issue an Executive Order to perform Emergency Legislation in times of crisis or emergency. Executive Orders may be overridden with a simple majority vote of the National Senate Section 5.) The President can be removed from Office with a 2/3 majority vote of the Cabinet if proven to be unable to execute the duties of the Presidency Section 6.) The President Nominates Members of the Supreme Court of Hutori from within the Hutorian Judicial System. Supreme Court Nominees must be confirmed by the National Senate by a simple majority. Article II.) PRIME MINISTER Section 7.) The Prime Minister is the Head of Government of the Federal Republic of Hutori Section 8.) The Prime Minister is considered the Leader of the National Senate and leads the government or governing Coalition within the National Senate. Section 9.) The Prime Minister Chairs the Cabinet as its executive and directly advises the President upon the advice of the Ministers of the Cabinet. Section 10.) In case of the incapacitation of the President of the invokement of Section I, Article 5 of this Bill the Prime Minister serves as the Acting President until new elections are called. Article III.) LINE OF SUCCESSION Section 11.) The Official Line of Succession in case of death of the President or members of the Cabinet is as follows: Prime Minister Deputy Prime Minister (If Declared) Minister of Foreign Affairs Minister of Internal Affairs Minister of Defence Minister of Justice Minster of Finance Minister of Infrastructure & Transportation Minister of Trade & Industry Minister of Health & Social Services Minister of Education & Culture Minister of Science & Technology Minister of Food & Agriculture Minister of Environment & Tourism Section 12.) If the President is incapacited or is killed in office it behooves the Acting President to call Emergency Elections as soon as the Crisis is averted or they are regularly scheduled; whatever happens first. |
