Congressional Speaker Act (4468) Article i - Purpose i) This act formally undertakes to enact, amend and reorganize, as necessary, the position of Congressional Speaker Article ii - Eligibility i) A party with seats in the National Congress is eligible for the role of Speaker i-a) The party of the Prime Minister is precluded from standing in Speaker elections. Article iii - Election i) The incumbent Speaker shall conduct the Speaker elections as Speaker Pro Tempore. ii) If not available the President of Beluzia shall conduct the Speaker elections as Speaker Pro Tempore. iii) The election of Speaker is conducted in the following manner: iii-a) Each party has the ability to submit a single candidate for Speaker. iii-b) All parties have 3 in-game months (9 hours) to submit a vote by secret ballot to the designated Speaker Pro Tempore. iii-c) If no ballot is received in that time that party's votes shall be marked as 'Abstaining' iii-d) All ballots are tallied and disclosed to the Congress for transparency. iii-e) If no candidate receives 51% of the vote then the party or parties with the least votes, in the event of a tie for last, is removed and another round of voting is called (iii-b). iv) If a candidate receives 51% support he is hereby appointed Speaker and will be required to take the oath of office. Article iv - Role of the Speaker of Congress i) The Speaker of the National Congress of Beluzia shall; i-a) Chair debates in the Congress. i-b) be responsible for keeping order during debates. i-c) ensure decorum between Members of Congress (MCs). i-d) ensure Congressional Standing Orders are adhered to. i-e) ensure all political positions are filled correctly. ii) Specific powers available to the Speaker include; ii-a) ability to direct an MOC to withdraw remarks if, for example, they use abusive language. ii-b) suspend the sitting of Congress due to serious disorder. ii-c) suspend MOCs who are deliberately disobedient - naming. ii-d) calling for order so MCs can be heard. iii) The Speaker also has an RP role namely; iii-a) Making representation to the mods upon player request to remove dead bills from inactive players. Article v - Impartiality i) Speakers must be politically impartial. ii) Therefore, on election the new Speaker must resign from their political party and remain separate from political issues until the end of their term. iii) They cannot vote on legislative issues, unless it is to break a tie. iv) However, the Speaker will deal with their constituents' problems like a normal MOC. v) When the Speaker is elected by other MOCs, they should automatically resign their seat and trigger a by-election. The constituency would then be properly represented. Article vi - Term Limits i) A speaker holds the position for the duration of the parliamentary term until elections are called wherein his position becomes vacant. ii) When a vacancy occurs a new speaker must be elected. Article vii - Removal i) The Speaker can be removed from office by a majority vote of Congress. ii) If a Speaker is removed a new speaker must be elected. Article viii - Oath of Office i) The Speaker is subject to the articles confirmed in the Oath of Office Act. Message | This is the law as it currently stands from various sections tidied up for viewing before we make adjustments so UBWP is the previous occupant - albeit his term has long since expired. Liberty have concerns about this previous system however. We felt the elections were too slow and convoluted and would like to see a revision in this area. |
