Bill: Jury of Peers Bill

Details

Submitted by[?]: United Equal Rights Council

Status[?]: passed

Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: March 4501

Description[?]:

This bill will make it law for anyone accused and charged with a crime to have a right to a jury of fellow citizens. While we do not believe that local governments would intentionally force a defendant to face a judge or jury, defendant´s should be allowed to face their fellow citizens. Seeing as though defendants can face a sentencing up to life in prison or a monetary fine and/or defendants can be falsely accused, a jury of peers shall be impartial and review the evidence without prejudice. Petty offenses such as traffic violations, theft, or other misdemeanors do not have to be judged by a jury.

Jury Selection Process:
- The states or local government puts together "a jury of peers" by first randomly selecting local citizens for the jury pool. The pool is then shaped during the jury selection, or voir dire, the phase of the trial. During jury selection, the judge, prosecution, and defense question each potential juror in order to determine whether there is anything in the juror's background that may prejudice his or her judgment in the case.

- The prosecutors and defense attorneys may then object to the inclusion of certain jurors. Attorneys have two types of objections to potential jurors: challenges for cause and peremptory challenges. While attorneys must have a legitimate reason to exclude a juror when making a challenge for cause, they typically do not need to give reasons for peremptory challenges.

Jury Duty Excuses:
- You have a medical inability
- You are an active member of a volunteer fire department, fire patrol, first aid or rescue squad.
- You are 75 years of age or older.
- You care for a minor child, or a sick, aged, or infirm dependent and have no alternative care available
without suffering severe financial hardship.
- You are a health care worker directly involved in the care of a mentally or physically handicapped person,
and your continued presence is essential to the regular and personal treatment of that person.
- You believe that you will suffer severe financial hardship.

NOTE: Police officers and lawyers are disqualified from serving as grand jurors but they may serve as petit jurors.

Pay:
- Citizens who must serve on jury duty for more than 3 days must receive a minimum wage for every day afterward.
