Description[?]:

Given that the Royal Veto remains in place in regards to the law on appointing the Patriarch of the Zhtál-Merlkai noble family as Chief Advisor to the Monarch in perpetuity, we propose an amended version of the bill.

It is our belief that a chief advisor acting as a direct liaison between the Grand Council and the King is a good thing as it provides a vital link between His Majesty and this house in a more day-to-day role than can be provided through weekly meetings with the Prefect. It also allows the King to have a voice in this chamber and to raise points without the need to attend himself and make the process of passing bills and receiving royal approval more seamless.

It is also a much more open way for the king to be advised and more in keeping with the processes of the nation, which allow the monarch to exercise powers and authorities within a democratic framework.

However, we fully take on board the recommendation of the Special Committee which states that the hereditary nature of the original bill did raise cause for concern and, therefore, we have removed this and replaced it with an electable Chief Advisor. Please note, we also reflect comments made in the Committee that there is no doubting the integrity of Duke Jebr Zhtal and will still propose him as the first appointee to the position.

This is the proposal:

Article 1 - A Chief Advisor (Jez Vezr) To The Monarch shall be appointed by the government;
Article 1(a) - The appointment of a Chief Advisor must be approved by a simple majority of the Grand Council and serves for 12 years (traditionally, two Grand Council election terms);
Article 1(b) - After the 12-year duration, the government may ask for the appointment to be rolled over for another 12 years or for a new candidate to be nominated (a simple majority vote is required in either case);
Article 1 (c) - If the Chief Advisor passes away or resigns his/her post due to other circumstances, such as illness, the government must immediately nominate a new appointee;
Article 1 (d) - On passage of this bill the first appointee to the role of Chief Advisor is Lord Jebr Zhtal, Duke of Vrkzel;

Article 2 - The Chief Advisor shall, where necessary, represent or assist the monarch on formal and state occasions, receive or liaise with ambassadors from foreign countries and take part in other ceremonial duties, as required;

Article 3 - The Chief Advisor shall assist and advise the monarch on the use of the Royal Veto, on the issue of the Royal Succession and other constitutional and legislative affaIrs;

Article 4 - The Chief Advisor shall liaise with the government of the day on behalf of the monarch and may address the Grand Council on legislation;

Article 5 - On occasions when the Monarch is temporarily incapacitated, absent or in the case of passing when the heir is not of adult age, the Grand Advisor shall act as Regent, overseeing the royal duties within the kingdom and in facilitating the royal succession as seamless as possible ;

(OOC: This is a constitutional RP Law, as governed by Section 6.e. of the Game Rules (http://forum.particracy.net/viewtopic.php?f=5&t=8088).As this introduces changes to the constitution it requires a 2/3 majority to pass, and it would similarly require a 2/3rds majority vote to overturn or amend it.

The King still contests this bill and will not sign this if it passes. The committee was there to judge whether his Royal Veto was correct, not to amend the legislation so they find it acceptable too. As such this will be considered illegal.

MessageMr Speaker,

We thank Mr Shlajkaisrmo for his response on the behalf of the King.

For clarity, the Special Investigations Committee made a recommendation following its ruling - a perfectly acceptable committee procedure to attempt to clear the constitutional impasse we face. Subsequently, we have acted upon their recommendation and added a significant democratic element to the appointment process.So, in short, we are happy with the legislation and believe it is a pragmatic compromise.

Does Mr Shlajkaisrmo have any amendments he wishes to make on behalf of the king? If not, we will shortly move it to vote and have every confidence that it will enter into law.
