Torres Law on Crimes

El guardar ADN de personas que han sido acusadas de un crimen un atentado contra el principio de presunción de inocencia, que establece que todos somos inocentes hasta que se demuestre lo contrario. Por ese motivo, debemos garantizar a los ciudadanos que el Estado cumple esta norma, y solamente aquellos individuos cuyos crímenes han sido probados verán su ADN guardado en el registro.

En relación con la representación legal de cualquier acusado, el Estado es el que, en primera instancia, debe tener un cuerpo de abogados de oficio para ofrecer a todos los ciudadanos, independientemente de su condición social. Si los acusados rechazan esta opción, es entonces cuando podrán, por iniciativa propia, contratar los servicios de un abogado privado.

Keeping DNA from people who have been accused of a crime is a direct attack to the principle of presumption of innocence, which establishes that we are all innocent until proven otherwise. For that reason, we must guarantee citizens that the State complies with this norm, and only those individuals whose crimes have been proven will see their DNA stored in the registry.

In relation to the legal representation of any defendant, the State is the one that, in the first instance, must have a corps of ex officio lawyers to offer to all citizens, regardless of their social status. If the defendants reject this option, that is when they can, on their own initiative, hire the services of a private lawyer.
