Description[?]:

I noticed there is this new legislation added to the game about the Appointment of the Judges/Magistrates: http://classic.particracy.net/viewvariable.php?variable=APPOINTMENT_OF_JUDGES_MAGISTRATES

Personally I feel uncomfortable with all the proposed options. I totally reject the appointment by elections, justice is not something on which to do politics or electoral campaigns.
But also the other ones... they are totally ignoring the vast and deep experience of latin and part of continental Europe about the management of the careers and the appointment of Judges and Magistrates. Probably the only one that can be the closest is the option giving to the HoS the authority to appoint Judges and Magistrates, but it is not at all a good or suitable option.
They ignore totally the existence of the "High Council of Judiciary model". For me as italian it is really uncomfortable and impossible thinking to politicians with the power to determine the appointment and the careers of the members of the judiciary. What about the indipendence of the Judiciary if Judges/Magistrates career/appointment depend by political decisions?

The options are so based on the anglo-saxons common law tradition...

What is your opinion on this to find a solution with the current presented options?

MessageI agree. Some options are not available like having a neutral body. I could go along with a HOS appointment procedure.

MessageOOC: Of course I would refuse the HOS appointment, as it is in any case a decision made by someone outside of the judicial system. We can RP a law that makes their election by passing a qualifying exam, instead of approving any of those laws.
