I refer the government to the results of a national opinion poll conducted in March 4709, viz:

10.58% Surrogacy is illegal.
43.46% Surrogacy is legal, and surrogacy agreements are enforceable. Only altruistic surrogacy is legal.
29.94% Surrogacy is legal, but surrogacy agreements are not enforceable. Only altruistic surrogacy is legal.
11.08% Surrogacy is legal, and surrogacy agreements are enforceable. Altruistic and gainful surrogacy is legal.
4.94% Surrogacy is legal, but surrogacy agreements are not enforceable. Altruistic and gainful surrogacy is legal.

The government's current policy is that "Surrogacy is legal, and surrogacy agreements are enforceable. Altruistic and gainful surrogacy is legal"

We put it to the party opposite that this position was supported by only 11% of our citizens.

In proposing a change to the position included in this Bill, the following supporting statements have been considered:

1. Only 11% of citizens took a position of making surrogacy completely illegal, which this party agrees with the party opposite is not a desirable policy.

2. Of the remaining citizens, the majority are clearly in favour of surrogacy agreements being enforceable. Again, this party is in agreement with the party opposite on this point.

3. Only 16% were in favour of gainful surrogacy. This party puts it to the party opposite that this should be reflected in its surrogacy policy and therefore proposes the following:

"That surrogacy should remain legal, but that gainful surrogacy be made illegal.

MessageIt is not only on the basis of the quoted opinion poll that this policy change is proposed, though that is a strong argument in its favour in its own right.

It is accepted that the proposed change does actually deprive our citizens of a full and free choice in the matter of surrogacy, but this party will note with interest how the government votes for or against more freedom of choice in other proposals being put before them.

More persuasive an argument than the appeal to an opinion poll is the following:

Gainful surrogacy is, in this party's view, somewhat distasteful. We would not wish to encourage the use of one's body for personal gain, which is a completely different matter to expecting compensation for offering oneself as a surrogate by way of re-imbursement of medical and other necessary expenses.

It is accepted that, should the demand for surrogacy be significantly higher than that available from purely altruistic surrogacy, then gainful surrogacy could then be considered, or at least re-introduced but with regulation (eg by a cap on the financial value of any compensation).

Until this scenario presents itself, the change in policy would only impact upon the choice of the surrogate without at all impacting upon the choice of the intending parents, who are after all the only citizens for whom we all agree should not be deprived of the benefits of surrogacy.
