Message | There are already other laws protecting the right to strike: Existing law #1: All workers have the right to strike Existing law #2: Trade unions must by law hold a ballot of all members before going on strike, a majority of all members, regardless of if they vote or not must approve the strike action. Law#1, however, is in the process of a change in legislation, which, when passed, will state: All workers have the right to strike but certain categories of workers regarded as critical to society have to ensure a minimal service. Both these laws will then have caveats applied to the overriding intention of supporting the rights of the workers to strike when deemed necessary. The Bill being introduced here brings a third existing law into line - i.e. it does not give employers the right to fire workers in principle. Rather, to prevent misuse of strike action (which would of course only weaken its effect when used appropriately), where there are not reasonable grounds for the strike action then the extreme case of firing workers can be instigated. Of course, there is no obligation for an employer to do so, and it is hoped that any underlying disputes can be settled amicably. Indeed, it is hoped that meaningful discussion takes place to resolve differences before any strike action is even considered or threatened or instigated. |
