The NPP would like to propose an act to provide for the establishment of a National Environment Courts for the effective and expeditious disposal of cases relating to environmental protection and conservation of forests and other natural resources including enforcement of any legal right relating to the environment and giving relief and compensation for damages to persons and property and for matters connected therewith or incidental thereto. Article 1: The Tribunal's dedicated jurisdiction in environmental matters shall provide speedy environmental justice and help reduce the burden of litigation in the higher courts. Article 2: It shall be guided by principles of natural justice. Article 3: The tribunal is mandated to make and endeavor for disposal of applications or appeals finally within 6 months of the filing of the same. Article 4: The Tribunal's main courts will be based in the capital cities of each county. Article 5: If the Defendant or the Prosecutor would like to move the case to the Supreme Court, It is possible as any other court in the country. The Supreme Court jury will have a member from the tribunal to provide the necessary details on the environment acts. |
