Bill: Withdrawing Unconstitutional Bills
Details
Submitted by[?]: Sinistra Ecologista
Status[?]: defeated
Votes: This bill proposes to change income taxes. It requires more than half of the legislature to vote yes. This bill will not pass any sooner than the deadline.
Voting deadline: November 4891
Description[?]:
Unfortunately the National Assembly passed many bills they didn't have the right to pass, as they are against our constitution. We therefore have to withdraw illegal laws, that violate our constitution. Any party voting against or preventing the restoration of the primacy of the constitution in the sources of law, will be subject to disciplinary measures under the intervention of the Costitutional Court. In particular our constitution [http://classic.particracy.net/newbill.php] declares that: "The State to persue this duty shall assure to all its citizens: - the access to a public and free healthcare - the access to a public and free education |

Message | May be the SE means by "our constitution", the SE party constitution. Otherwise, my party does not know what the SE is talking about. Apart from that, the PNI find SE's presentation and this proposal as a sign of arrogance, undemocratic behaviour, misinformation, abuse of power and blackmail. Besides, my party wonders why this bill could not be debated properly in the Assemby in the first place. That would have been proper and more in line with their own interpretation of "the constitution". We are confident that our "NO" to this outragious proposal will stand every legal action the SE have in mind. Eliza Rangotti Partyleader |

Message | Constitutional law DHoS 01/4559 - (RP) Constitutional Law on the Duty of the State Toward the Citizens and to Promote a Fairer Society for a Greater Well-Being of All Our Citizens [http://classic.particracy.net/viewbill.php?billid=598451]. In fact there has been a mistake and the assembly member couldn't get a copy of this passage as we wanted to do, therefore I thank mrs. Rangotti to point it out. I hope that now the constitutional law I was referring to is clear to everyone. Maria Carlabia, Istalian constitutionalist, jurist and academic |

Message | Yes, we knew that. It was sarcasm from our side. We acted according to the constitution. The PNI stands with its statement made ealier and we are happy that this bill is defeated. Eliza Rangotti |

Message | Mr. Speaker, The Constitutional Court did not issue any modifications and approved the changes to the law as they were in the bill. In the rule of law it's not the parties job to decide if their bill is constitutional or not, it's the court's job. Therefore no politician can be blamed for the mistakes the court has committed. We will not withdraw the changes until the court finds them unconstitutional. We will propose change to the constitution as soon as possibble. Bianca Bellusconi, leader of the FCN group |
