Mme Speaker, The government will reintroduce the "Underage Employement Regulatory Text (UERT)" which, despite the unfair criticism IeU received and the mud throw out against us, depicted as child labour exploitators, indeed sets the appropriate safeguards and limitations in defense of minor workers. The Federal Labour Departement established by the previous administration will exercise and coordinate the supervisory function in the federal territory regarding the application of the following provisions as well as to manage the already established matters related to labor, contributions, insurance and social legislation, including supervision for the protection of the health and safety of workers. The text will provide what kind of jobs the underage workers will be allowed to do and in what kind of conditions as follow: - Only minors who are at least 14 years can enter into world of work, but when it is cultural, artistic, sports, advertising and entertainment industry working activities, minors of 14 years old can work but only with the written consent of the parents and with the authorization of the Federal Labour Department. - Minors can not perform jobs that potentially could harm their full physical and psychic development - Minors can not perform jobs classified as dangerous and high intensive. - Minors can not perform jobs classified as high responsibility. - To minors is prohibited carry out the work at night from 22 to 7 o' clock unless it is a cultural, artistic, sports, advertising, turism, catering and hotel business or in the entertainment industry and the work does not exceed midnight, but exceptionally and for the strictly necessary time, they can be used for night work in cases of force majeure which hinder the operation of the company, provided that such work is temporary and does not allow any delay, adult workers are not available and are granted equivalent compensatory rest periods within three weeks. The employer must also give immediate notice to the Federal Labour Department. - Minors must be guaranteed a rest period of at least two days a week, if possible consecutive and including Sunday. The minimum rest period may be reduced for justified technical and organizational order, but in no case be less than 36 consecutive hours. The rest periods may be interrupted in the case of activities involving periods of split or short duration work in the day. It also foresees the possibility to grant the weekly rest also on different days from Sunday to minors employed in working activities of cultural, artistic, sports, advertising, turism, catering and hotel business or in the entertainment industry. - To be able to start to work the teenager has to undergo a medical check before to begin and to regular check during the work period. - Maximum workingtime 8 hours/day for those minors which have finished their school courses gaining a professional degree. - Maximum workingtime 6 hours/day for those with no professional degree. - Maximum workingtime 6 hours/week for those involved in school-work cooperation programs. - The job, if out of schooling programs, shall not interfere with school courses and with the child right to the study, but minors can follow home schooling at the request of the parents if homeschooling is permitted. - The provisions of the UERT does not apply to teenagers (>14) employees in occasional or short-term jobs concerning domestic service in the family and performance of work not harmful or detrimental for the already all mentioned rights of minors or dangerous in family businesses.
