Article 1. Establishment The National Congress. the parliament of Yindala Da Tong, shall be the representative and legislative body of Yingdala and shall exercise the legislative power of the state. Article 2. Composition and Membership Section 2.1. The National Congress shall be composed of deputies elected from the provinces and special administrative regions. The election of deputies to the National Congress shall be presided over by the Commission on Elections. Section 2.2. The number of deputies in the National Congress shall be fixed by law and shall not be less than 75 and shall not exceed 750 at any given time. Section 2.3. The tenure in which deputies in the National Congress serve shall be fixed by law. Article 3. Qualification and Disqualification of members Section 3.1. Any person who is a Yingdalan citizen and is at least 21 years of age may be qualified to be a Deputy in the National Congress. Section 3.2. Any person who is not a citizen, voluntarily acquired the citizenship or has exercised rights of citizenship in a foreign country, has shown, through act or speech, to be disloyal to His Imperial and Royal Majesty the Son of Heaven, or is declared to be of unsound mind under the law, is disqualified to be a Deputy in the National Congress. Article 4. Tenure and Vacancies Section 4.1. The tenure in which deputies in the National Congress serve shall be fixed by law. Section 4.2. The National Congress may dissolve itself or be dissolved by the Son of Heaven. Every Deputy of the National Congress shall cease to be a Member upon dissolution of the National Congress. When the National Congress is dissolved, there must be a general election of members within thirty (30) days from the date of dissolution. When the National Congress is dissolved the Cabinet may assume the authority of the National Congress. Measures taken at such session shall be provisional and shall become null and void unless agreed upon by the National Congress within a period of four (4) months after the opening of the next session of the National Congress. In the event of a dispute between the two, the National Congress shall resolve. Section 4.3. A seat of any Deputy in the National Congress shall become vacant if: he holds an office of profit under the Imperial crown; he, by writing to the Clerk of the National Congress, resign his seat in the National Congress; and by any circumstance that may disqualify a person from holding the title of Deputy. Section 4.4. A Deputy who vacates his seat, or whose seat is vacated due to circumstances mentioned in Section 4.3.1, and is still qualified to hold the title of Deputy, may run for such office as prescribed by law. Article 5. Presiding Officer and Other Appointments Section 5.1. The Deputies of the National Congress must, at the opening of each session following an election, elect a presiding as prescribed by law. Section 5.2. The Presiding Officer of the National Congress is responsible for the functioning and management of the National Congress and the legislative process. Section 5.3. The Presiding Officer of the National Congress may, at the advice and consent of the majority party floor leader and the minority party floor leader, appoint members to committees, along with the Chair, Vice Chair, and Ranking Members of said committee. Article 6. Powers and Functions Section 6.1. The National Congress has the power to make laws for the welfare of Yindala Da Tong. Section 6.2. Other powers of the National Congress include, but not limited to, the: power to collect taxes; power to spend for the general welfare and the common defense; power to borrow money; power to establish post offices and roads; power to regulate patents and copyrights; power to ratify treaties; power to establish administrative regions; power to promulgate regulations; power to provide consent; n government appointments; power to establish piracy laws; and power to create laws that are proper and necessary to carry out the laws of the land. Section 6.3. The National Congress shall adopt procedural rules and solve issues of procedure for its work. Section 6.4. The National Congress shall set up committees and commissions, hold parliamentary hearings and investigations on issues within their authority. Section 6.5. The National Congress shall, every other year, review the Constitution. The National Congress may, with Imperial Assent, amend the constitution. Section 6.6. All members of the National Congress shall adhere to the Oath of office. The National Congress may provide that the Prime Minister and members of the National Congress shall take the Oath of office as required by law. Section 6.7. The Prime Minister and other Ministers shall, from time to time, appear in the National Congress to speak on matters of legislation, current events, or for whatever reason the officials choose to do so. Section 6.8. Measures taken by the National Congress may be approved, modified, or annulled at any time by the Son of Heaven. The Son of Heaven may also exercise the function of the National Congress on the advice of the National Congress. Section 6.9. The National Congress may create rules and procedures governing the Deputies of the National Assembly, including the impeachment of its members, the Prime Minister, and the Ministers of the government. Article 7. Privileges of Deputies Section 7.1. Members of the National Congress shall receive appropriate annual payment from the national treasury in accordance with law. Section 7.2. Deputies of the National Congress may not be prosecuted for actions taken or words spoken as a Deputy of the National Congress, however, Deputies can be prosecuted for any breach of the Constitution by criminal law. Section 7.3. Members of the National Congress shall possess the right to speak and be heard in the house. They shall not be required to sign any of the documents that would be prepared in connection with any of the business of the National Congress. The National Congress shall provide proper facilities for the members to exercise their rights. Article 8. Enactment This law shall be enacted by 2/3 of the members of the Grand Assembly. |
