Under the aegis of the parliamentary bill RP Federal Constitution Act, 5169, the Maliviya Mahasabha proposes this draft constitution for further consideration of all stakeholders of the Pratinidhi Sabha i.e. Malivia Ganatantrik Party, Malivia Janata Sena Party, and मज़दूर संघ. The proposed articles are as follows ( For a better view you can use this google doc as well -https://docs.google.com/document/d/18Qic8pkUyEKDsmvK2O9jBUke_xa5ty7eXKoOvpkobF4/edit?usp=sharing) :- Article 1 - Maliviya Prajaataantrik Ganatantr/Malivian Democratic Republic (Malivia) shall consist of (i) the Central Territory of Kubir i.e. the Capital, and (ii) the five Rajyas (excluding Kubir in the case of Dendhradas Rajya since Kubir serves as the national Capital). Article 2 - This constitution, however, empowers the National Parliament or, Pratinidhi Sabha to alter the status of any Rajya or, Central Territory given the condition that a special majority i.e. 66%of the vote is reached. Article 3 - All the five Rajyas shall have their own autonomous government known as Local Government elected on the basis of the result of the Federal elections. All the information related to the election of the Local Governments is in the first Schedule of the Federal constitution. Article 4 - The Central Territory of Kubir by virtue of being the Capital shall be directly administered by the Central Government and shall not come under the jurisdiction of the Local government. Article 5 - In case of maladministration, the Rashtrapati can declare an emergency in a Rajya. In such circumstances, the concerned Rajya shall be directly governed by the Rashtrapati and the local government shall be dissolved. Article 6 - Emergency declared by the Rashtrapati shall only be in effect till a new election. The Pratinidhi Sabha can reverse the declaration of Emergency providing they secure a special majority in the National Parliament. Article 7 - The Central Government and the Local Government have to function strictly in accordance with the distribution of powers enshrined in the (in game) Constitution. [OOC: that is to say that the Local Government shall enjoy power or rights only over those categories or, topics that have been left to the local government all other powers shall rest with the Central Government. For Example, Article 12 of the In game constitution notes “Certain powers may be devolved to the Local Governments by the Pratinidhi Sabha in accordance with the procedures set out in Article 3.” Although the article do not give details of the mentioned “certain powers,” this can be inferred from the active laws for instance in the active law section abolition policies were given to the local governments to decide. So, the Local Government will decide on this not Central Government. See below - Health The right to perform an abortion for a pregnant woman. Abortion policies are established by local governments Alternatives: All abortions are illegal. Abortions are only allowed in medical emergencies. Abortion is allowed during the first trimester. Abortion is allowed during the first and second trimesters. Abortion is allowed during the entire course of the pregnancy.] Article 8 - Since the Mayor can head a number of cities, the Head of the Local Government shall be the Mayor. [OOC: the original in game constitution or, Laws do not have any provision about the Chief Minister. However, it does have provisions for Mayor. Hence, I believe it would be better to name the post Mayor. Whereas the Cabinet shall go by the name Municipal Council and the Whole Government will be known as Local Government. This is to make the RP Constitution in consonance with the In game Constitution and Laws. Otherwise, it would become Role Playing only and a bit ineffective and lacklustre, to be honest.] Article 9 - The Mayor shall have a cabinet known as a Municipal council to assist in the works of the Local Government. Article 10 - Only the elected members of the Local Parliament can become a Mayor, or take part in the Municipal Council and the Local Government. Article 11 - A Municipal council/Local Government shall cease to function/dissolve given it fails to hold an absolute majority i.e. 50% of the seats in the Local Parliament. Article 12 - A Mayor can be impeached if the opposition secures 66% of the votes against him/her. Article 13 - Subject to the provisions of Article 3 of the (in game) Constitution, the Pratinidhi Sabha shall have the power to add, amend, or abolish any of the articles enshrined in this constitution subject to a vote of two-thirds of the members of the Pratinidhi Sabha in order to pass. Schedule 1 of the Federal Constitution: Election Process Article 1 - The Central election and the Local Elections shall take place simultaneously. Idhaghra Rajya: Party Votes Votes (%) Seats Seats (%) Malivia Ganatantrik Party 4,343,790 36.96% 20 36.36% Malivia Janata Sena Party 4,184,409 35.60% 20 36.36% मज़दूर संघ 3,224,368 27.44% 15 27.27% Total 11,752,567 100% 55 100% (See the table properly here - http://classic.particracy.net/viewnews.php?newsid=756045 ) For example, at Idhaghra Rajya (See the table above), MGP and MJS won 20 seats each and Majdoor Sangh won 15 out of 55 seats. Now to form a Local Government at Idhagra one needs 28 seats out of 55 seats. So, in case MGP and MJS form a coalition they reach 40 seats out of 55 which is way ahead of 28 the actual magic figure. Hence, the Coalition may form a Local Government at Idhagra or, vice versa in any other case. [OOC: please feel free to raise doubts/objection/suggestion of any kind.] |

Message | To all the members of the Pratinidhi Sabha, here we propose a draft constitution. Since the proposed constitution puts Mayor as the head of the Local Government we propose that the Local Governments decide on the Mayor. However, It is not a mandatory change. We ask our fellow compatriots to provide their valuable feedback on the same. Jai Malivia ! |
