IN RESPONSE to the situation in Jildrath and in knowledge of the fact this kind of act has not been seen in Kundrati, this bill hereby enacts ARTICLE I: - The National Government may declare the following states of emergencies. - State of General Alarm, defined as a state where the national security or a State security is threatened but doesn't run the risk of a major escalation - State of Emergency, defined as a state where a situation that cannot be controled by a State occurs which requires national attention - State of Siege, defined as a state where the country is a maximum risk for conflict, internal or external, that requires full national resources for a small period - State of War, defined as a state where the country cannot deal with the emergency on it's own and requires full national resources for a sustained period - The State Governments can only declare either a state of general alarm or a state of emergency. Only the National Government may declare a State of Siege or War. - States who declare a state of emergency are expected to handle the situation with their state police and may be allowed to detain peoples without charge for up to 7 days without charge ARTICLE II: - The National Government shall be given the authority to declare curfew, which shall last from 6am to 10pm, with or without consultation by the States - The State Governments shall be given the authority to declare curfew for the same times - Curfews shall last for 60 days or until the emergency is declared over ARTICLE III: - States of General Alarm may only be declared on either natural disasters or small cases of terrorism - State police may be called in only to assist and provide assistance, however the military cannot be called in - States of general alarm may be declared at any time and renewable at any time ARTICLE IV: - States of Emergency may be declared on natural disasters or extreme cases of terrorism - State police may be called in order to suppress the situation, including SWAT teams - Military force is not allowed under a state of emergency - States of emergency may be declared for up to 90 days, renewable up to three times ARTICLE V: - States of siege may be declared only by a two thirds vote of the National Assembly and shall last only for 30 days renewable once - The military may be called in to suppress the situation - This may also include detainment of peoples for up to 7 days without charge - Protestors may be prohibited from forming groups up to ten ARTICLE VI: - States of war may be declared only by a two thirds vote of the National Assembly and shall last for the duration of the emergency - State of war should be considered martial law and the military may suspend habeas corpus on advice of the Government and only on a state of war. - This may also include detainment of peoples for up to 30 days without charge - Protestors may be prohibited from forming groups up to six - The Government may intervene to cut internet or telecommunications service - Military resources may only appear during a state of siege or a state of war ARTICLE VII: - This bill shall go into effect immediately upon a two thirds vote of the National Assembly - This bill may be repealed via a regular vote of the National Assembly |
