If this proposal is approved by two thirds of Assembly of Republic, new constitution will be approved. Proposal: CONSTITUTION OF THE TUKARESE REPUBLIC SECTION 1 The Tukarese Republic Article 1 Tukarali is a sovereign and democratic nation. Sovereignty belongs to the people of Tukarali, who elect their representatives directly to govern the country. Article 2 Tukarali is a unitary presidential republic, divided into administrative regions for the purposes of governance and representation. The country is governed by a President, who is elected by the citizens of Tukarali to serve as the head of state and government. Article 3 The Tukarali flag is made up of the colors blue and yellow, and the country's emblem. The Tukarali flag, along with the coat of arms, are the country's national symbols. Article 4 Tukarali's national anthem is "the Anthem of Independence", adopted in May 5096. Article 5 The official language of Tukarali is Tukarese, however several other languages that are also spoken by the population are recognized by the government, including regional and native languages. Article 6 The federal government of Tukarali is divided into 3 branches, which are independent and harmonious with each other: the Executive branch, the Legislative branch and the Judiciary. I - The Executive branch is responsible for governing Tukarali. It is led by the President, who serves as both the head of state and government; II - The Legislative branch is responsible for approving and creating laws in the country. The legislative body of Tukarali is the National Assembly, which is made up of elected representatives from each administrative region; III - The Judiciary is composed of a Supreme Court and other courts of the country. The Supreme Court is led by the Chief Justice of the Supreme Court, who generally serve 2 to 3 years. SECTION 2 The President of Tukarali Article 7 The President of Tukarali is the nation's head of state and government. He represents the country. Article 8 The President has powers and duties, which are: I - Dissolve the National Assembly; II - Convene the National Assembly; III - Guarantee the independence of Tukarali; IV - Guarantee the constitution of Tukarali; V - Appoint the judges of the Supreme Court; VI - Attribution of positions and honors (Example: Order of Military Merit of Tukarali); VII - Exercise their ceremonial functions. Article 9 The President can be removed by the National Assembly through an impeachment process. Impeachment proceedings can be carried out in the case of: I - Breaking laws; II - Committing crimes of corruption; III - Diversion and money laundering; IV - Political crimes. Article 10 The President is democratically elected by the citizens of Tukarali every 5 years, and can serve only 2 terms. If the President serves more than 2 terms, the National Assembly can also initiate an impeachment process. Article 11 The President is responsible for receiving heads of state and ministers from other countries. Article 12 The second person in the line of succession to the President is the Vice President, and the third person is the President of the National Assembly. Article 13 After resignation or impeachment of president, new elections must be called. SECTION 3 The National Assembly Article 14 The National Assembly is the legislative body of the Tukarese Republic. The National Assembly represents the population of the country and the administrative regions of Tukarali. Article 15 The Assembly of the Republic is unicameral. The members of the Assembly of the Republic are directly elected by the population every 4 years, regardless of whether the election is an early election or a regular election. Article 16 The Assembly of the Republic, in addition to being the country's legislative body, has powers and duties like other offices. These powers and duties are: I - Propose bills; II - Approve bills; III - Approve treaties; IV - Propose and approve amendments to the constitution of Tukarali; V - Approve a cabinet. Article 17 The members of the Assembly of the Republic elect a President of the Assembly to direct and organize the sessions, and to administer the Assembly of the Republic. The President of the Assembly of the Republic can serve between 2 and 4 years, but does not have a fixed term limit. SECTION 4 The Judiciary Article 18 The Judiciary is the branch of government responsible for interpreting the laws and resolving legal disputes. It is composed of the Supreme Court, other courts, and judges. Article 19 The Supreme Court is the highest court in Tukarali and is responsible for interpreting the constitution and resolving disputes between the branches of government. It is led by the Chief Justice of the Supreme Court. Article 20 Judges are appointed by the President of Tukarali, with the approval of the Assembly of the Republic. Judges serve for life and cannot be removed except for misconduct or incapacity. Article 21 The Judiciary is independent and impartial, and its decisions are binding on all citizens of Tukarali. SECTION 5 National Symbols Article 22 The national symbols of Tukarali are the flag, the coat of arms, and the national anthem. SECTION 6 Amendments to the Constitution Article 23 The constitution of Tukarali can be amended by the Assembly of the Republic with a two-thirds vote of its members. Article 24 Any amendment to the constitution must be signed by the President of Tukarali before taking effect. SECTION 7 Transitional Provisions Article 25 This constitution takes effect immediately upon signing by president. Article 26 All laws and regulations in force in Tukarali remain in effect until they are modified or repealed in accordance with the provisions of this constitution. Article 27 All public officials, including the President and members of the Assembly of the Republic, shall continue in their respective positions until the expiration of their terms or until they are removed in accordance with the provisions of this constitution. Article 28 The government of Tukarali shall take all necessary measures to ensure the orderly transition to the new system of government established by this constitution. |
