Indrala-New Endralon Comprehensive Free Trade Agreement (4356)

Indrala and New Endralon, hereinafter referred to as “the Parties”, resolved to:

Strengthen the special bonds of friendship and cooperation between their peoples;

Contribute to the harmonious development and expansion of world and regional trade and to provide a catalyst to broader international cooperation;

Create an expanded and secure market for the goods and services produced in their territories, as well as promote new employment opportunities and improved working conditions and living standards in their respective territories;

Have agreed as follows:

Article 1: Tariff Elimination on Imports
(1.1) A Party may not increase an existing customs duty, or adopt a customs duty, on an originating good.
(1.2) A Party may not adopt or maintain a prohibition or restriction on the importation of a good of the other Party or on the exportation or sale for export of a good destined for the territory of the other Party.
(1.3) A Party may not adopt a tax or tariff on electronic purchases made between the each party.

Article 2: Trade Facilitation
(2.1) Each Party shall publish or otherwise make available, including electronically, its legislation, judicial decisions and administrative policies relating to import or export requirements.
(2.2) Both Parties agree to promote trade and establish joint institutional mechanisms which will aid the development and ease of bilateral trade and dispute settlement.

Article 3: Investment
(3.1) Each Party shall accord to investors of the other Party, and to covered investments, non-discriminatory treatment with respect to measures it adopts or maintains relating to losses suffered by investments in its territory owing to armed conflict or civil strife or legislation which violates the principles of equal competition espoused in (1.2).
(3.2) Each Party shall permit all transfers relating to a covered investment to be made freely, and without delay, into and out of its territory. Such transfers include:
(3.2.1) contributions to capital;
(3.2.2) profits, dividends, interest, capital gains, royalty payments, management fees, technical assistance and other fees, returns in kind and other amounts derived from the investment;
(3.2.3) proceeds from the sale of all or any part of the covered investment or from the partial or complete liquidation of the covered investment;
(3.2.4) payments made under a contract entered into by the investor, or the covered investment, including payments made pursuant to a loan agreement;
(3.3) Each Party shall accord to investors of the other Party treatment no less favourable than that it accords to its own investors, in like circumstances, with respect to the establishment, acquisition, expansion, management, conduct, operation and sale or other disposition of financial institutions and investments in financial institutions in its territory.
(3.4) Each Party shall allow investors and entrepreneurs of the other Party to establish or expand a business within the other party's territory under the same treatment of its own investors and entrepreneurs.

Article 4: Ratification
(4.1) As long as both Parties are signatories to this agreement, it shall be considered valid and in effect.
