Herr Präsident, the coalition has decided that, although we remain overall committed to the employment protection clause enacted by the Rauchgesetz of 3613 (http://classic.particracy.net/viewbill.php?billid=401095), the law requires a review regarding the standards it establishes for cafés. There has been some unclarity the licensing system imposed on cafés by the Rauchgesetz - this bill seeks to clarify these problems. The respective articles of the original Rauchgesetz, namely (2) Places that primarily serve liquor are exempted from the requirement; (3) Licensed cafés shall be exempted from the requirement; shall be interpreted in such a way that cafés need only to apply for a license if it is not clear beforehand that they fall under the liquor exemption of (1). Furthermore, Article 3 should be interpreted in such a way that it allows cafés, especially small ones, which primarily and above all aim to serve as a meeting place for smokers, to obtain licenses without invasive bureucratic hurdles. Message | Herr Präsident, I am glad to see that my colleague Herr Holzinger has cleared up this early flaw in the Rauchgesetz which would have impacted disproportionately on small businesses in a sector very important to Hulstrian culture. He makes sure the licensing system works as intended: to ensure cafés, like liquor-excepted businesses, can be exempt from the rules if they want. There are already licenses to sell liquor - there aren't any to operate a café. The licensing system is important so we can effectively control whether the age restrictions on tobacco are observed. Message | Herr Präsident, There is no solid evidence that the smoking ban will affect cafes in a negative way. If anything, non smokers will be encouraged to go into the now beautfiul and smke free surroundings of the cafes. DS rejects this and we would prefer a blanket smoking ban in public places, we only voted Aye last time because we hoped the ban would be extended rather than very slimy exemptions for favoured enterprises. .
