A BILL to devolve responsibility for regulating the prices of local public transport tickets to the Crownlands and the Gemeinden.

BE IT ENACTED by Her Imperial and Most Illustrous Luthoran Majesty, Kaiserin Josephine of Hulstria, and His Imperial and Heavenly Majesty the Hosyu Emperor, Go-Kurosawa of Gao-Soto, by and with the advice and consent of the Imperial Diet and the Länderrat of Hulstria and Gao-Soto, at Kien assembled, and by the authority of the same, as follows-
ERLASSEN vom Ihrer Kaiserliche und Erlauchte Luthoranische Majestät, Kaiserin Josephine von Hulsterreich, und Seiner Kaiserliche und Himmlische Majestät, Gosyu-Mikado Go-Kurosawa von Gao-Soto, vom und mit Rat und Zustimmung des Reichstages und Länderrates Hulsterreichs und Gao-Sotos, in Kien versammelt, und auf Autorität des gleichen, wie folgt-

1) Principle of subsidiarity
(1) The regulation of prices for public transport services shall, as a matter of principle, be placed on the level on which the service is operated;
(2) Subject to this principle of subsidiarity, Gemeinden shall have primary responsibility for regulating the prices of tickets on local public transport services such as city buses or tramways;
(3) Subject to this principle of subisdiarity, Crownlands shall have primary responsibility for regulating the prices of any form of public transport that operates at a level higher than the Gemeinden (in discussion with the affected Gemeinden) but within their Crownland borders;
(4) Subject to this principle of subsidiarity, the regulation of pricing on services operating between multiple Crownlands, such as the train network, shall remain with the Minister for Infrastructure and Transport, who shall, in the exercise of this power, have a duty to consult the Crownland governments.

2) Power to regulate prices
(1) The competent authority shall, in services it operates of its own accord, have full power over prices;
(2) The competent authority shall, in services it franchises to a company, have the power to place certain demands on the franchiseholder during negotiations on the franchise itself.

3) Power of the Minister to make special provision for reductions for certain groups
(1) The Minister of Infrastructure and Transport may by order decide that certain specific groups, such as pensioners or students, be given reductions or free passes;
(2) Where an order under section 3(1) is made, the Minister shall duly compensate the party for the loss of revenue by means of an annual sum negotiated between the Minister and the competent authority or company;

4) Power of the Minister to intervene; principle of non-discrimination
(1) Where in the opinion of the Minister it becomes apparent that disparities in ticket pricing become harmful to the economic interests, he may in consultation with the competent authority impose limits on ticket pricing;
(2) It shall be illegal for the competent authorities to charge non-residents of that authority for higher prices than residents of that authority, unless a reduction for a specific group (eg, schoolchildren) is in effect.

Today I am proud to reintroduce the Fahrscheingesetz on behalf of Frau Goddestreu, who previously introduced it. A vital part of the coalition programme, the Fahrscheingesetz is a major step towards empowering local communities to seek tailored solutions. In many ways, the many Crownlands and Gemeinden differ - cities rely on public transport to a different degree and in a different manner than rural areas. What we are proposing is the devolution of fares policy, ticket pricing and subsidisation to the local governments which know these areas best.

We oppose this reform because we are disturbed by the prospect that right-wing local authorities would take advantage of it to reduce or even terminate public transport subsidies.

if the "right wing" would be willing to do this then we'd already have done it nationwide in the 18 consecutive years this coalition has now been in power. The truth is, both HDV and LVP are committed to assisting people who rely on mobility, but will allow creative local solutions for this task while the Socialists would prefer to nationalize and centralize public transport regardless of the economic inefficiencies and shortcomings such a policy would produce.
