| The time has come for Kalistan to have a written Constitution which describes the governing regime of Kalistan. The Kalistani Constitution used to exist in the form of the Kalistani Laws. Now we should rewrite the Constitution. This bill will exist as the record of the Constitutional Convention, and a second bill will be proposed to ratify this bill once it is composed. The structure of the Constitution shall be as follows Preamble, Style and National Variables of Kalistan Art 1- Legislature Art 2- Executive Art 3- Judiciary Art 4- The Empire Art 5- RP Rules Art 6- Party Organizations and Militias Art 7- The Bureaucracy |

| Message | Article 1- The National Assembly of Kalistan Section 1- The Legislature of Kalistan shall be a Bicameral Legislature a) The Lower House shall be titled the National Assembly b) The Upper House shall be titled The Assembly of Advisers Section 2- The National Assembly a) The National Assembly shall be vested with the sole lawmaking power of the Republic b) There shall be 750 Seats in the National Assembly c) All regular elections shall be scheduled for every 36 months. d) The Party which receives the most seats shall be known as the "Plurality." e) All Parties are entitled to form informal governing blocs and propose all Legislation. f) No Party is entitled to form taxation or spending bills, or make Government proposals as a normal course of legislation. g) The National Assembly will vote to confirm Advisers. While this vote is meant to be a formal declaration of support for the choice of the President in his own advisers, the Assembly may only vote against the nomination of an adviser to express no confidence in the President. The President then, should (but is not required to) call for an early election. h) Only the National Assembly may declare Wars or agree to RPs. In all RP and War votes, all players with seats in the National Assembly must agree to the RP before Kalistan may participate. i) The National Assembly may pass all non-binding OOC and IC Resolutions, and Amendments to this Constitution. Section 3- The Assembly of Advisers a) The Council of Advisers is convened at the pleasure of the President of the Republic. b) The Assembly of Advisers has no legislative power. Their only power is to offer advice to the President of the Republic. c) All Advisers have the power to speak on any bill that is before the Assembly, and attempt to influence the outcome of all legislation. d) Citizens will be qualified to serve if they have served at least 10 years in any Republican Office (either in the Lower House, or the Military/Civil Service, or in the cabinet, or in any other national office.) e) Advisers will be nominated by the President of the Republic. The President will name, as needed, an equal number, not exceeding three, from each Party with one or more seat in the lower House. The President of the Republic will also be entitled to name one extra adviser from his or her own Party to serve as President of the Assembly of Advisers with the power to break ties. f) Each Party who has at least one seat may submit the names of Advisers that it prefers. The President may opt to disregard these recommendations. Parties may opt to not nominate anyone, and just hand the choice to the President, if this is their inclination. g) The term of Office for all advisers is for life or until retirement. h) The President of the Assembly may be replaced at any time, for any or no reason at all. |

| Message | Article 2- The Executive Section 1- The Head of State in Kalistan shall be known as the President of the Republic a) The President shall create all Governments in Kalistan. i) Decisions SHOULD be made with the advise and consent of the Plurality. ii) Decisions should be made in accordance with the longstanding principle of Separation of Powers, where the Head of State and Head of Government should NOT be from the same Party, no matter what other consideration is made in the formulation of the Cabinet bill. iii) In accordance with the Principle of Separation of Powers, the Head of Government must be the head of the Plurality, but may be the head of the largest non-Presidential Party in the Governing Coalition if the Plurality Party is not in the coalition. b) The President shall have the power to nominate all Advisers in the Assembly of Advisers. c) The President will be entitled to choose as a Personal Guard one of the following groups: i) The Militia of the President's Party ii) The Militia of the Prime Minister's Party iii) The National Security Agency d) The President shall have the power to issue International statements on behalf of the Republic e) The President will be the primary adviser to the Emperor f) The President shall be entitled to name an additional member of the Constitutional Court, and shall convene Constitutional Courts once every six years, or as needed. g) The President will serve as Commander in Chief of the Regular Armed Forces of Kalistan. h) The President may pardon any citizen for any reason i) The President shall be elected directly by all eligible citizens of the Republic. The President's term of Office is 3 years. The President may serve an unlimited number of Consecutive terms. j) In the Event of vacancy of the Presidency, or incapacity of the President, the Prime Minister will serve as President of the Republic until the next Regular Election. Section 2- District Government a) The Party which wins a District shall be declared in control of the Government of that District. b) All laws in the Districts, for the purposes of RP shall conform with the National Constitution and active legislation. If the National law specifically forbids some act, no state Government may do that. c) District Governors do have the right, in emergency situations, to not enforce laws. d) The National Government shall retain the right to send National forces into some district to ensure compliance with the law, if a district government is acting in contravention to the law. e) A District Government shall remain in the hands of a Party so long as the Party controls that District as the result of a sanctioned and legitimate election. And armed forces associated with that district shall be added to the Party's Militia. The Governor shall act as Commander in Chief of all the armed forces specifically allocated or raised and supported by that District. |
