We, the Malivian Socialist Party presents an administrative mandate that creates the highest judiciary in Malivia, the Malivian Supreme Court. SECTION ONE: Identity 1. The supreme court is officialy known as the Malivian Supreme Court. 2. The supreme court consists of 11 politically independent judges that serves a lifelong term with a choice of resignation, if wanted or requested. SECTION TWO: Powers and Responsibilities 1. The Supreme Court has the highest judiciary powers in the whole country. 2. The Supreme Court is the one that handles the day by day running of regional courts around Malivia. 3. The Supreme Court is the ome that can only hold impeachment trials. III. Registry of Judges 1. Judges would be appointed by their performance in their duties. 2. Message | I have an issue with the Head of State appointing judges because what if the Judge is on trial? Will the judge not be more inclined to rule in favour of the President? I think the judges should be appointed by an independent body |

Message | The minister of justice is a politician. What if the minister of justice becomes the evry person on trial? Judges should not be chosen by politicians else that would surely not make them politically independent. Imagine if the minister of justice is on an impeachment trial. Also I do not think the judiciary should handle impeachment in first phase. That should be done by Parliament and once it's passed, if the impeachment is of a criminal nature, then it goes into the judiciary. What if an executive member is impeached simply for misconduct in public office that isn't criminal, should they also be handled by the judiciary and waste courts time and resources? Therefore, with all that said , my political party cannot support this bill as we believe there are some issues that need to be ironed out. However we do commend the MSP for trying and maybe the government will place this on its agenda for this term. |
