Description[?]:

AN ACT to prevent the spread of corrupt elements.

Section 1
a)Every person who, by himself or by or in conjunction with any other person, corruptly solicits or receives, or agrees to receive, for himself or for any other person, any gift, loan, fee, reward, or advantage whatsoever, as an inducement to, or reward for, or otherwise on account of, an agent doing or forbearing to do anything in respect of any matter or transaction whatsoever, actual or proposed, in which the State or a public body is concerned, is guilty of an offence and is subject to imprisonment for 20 years.

Section 2
a) corruptly uses official information for the purpose of obtaining any gift, loan, fee, reward or advantage whatsoever for himself or any other person, or corruptly communicates official information to any other person with a view of enabling any person to obtain any gift, loan, fee, reward or advantage whatsoever, is guilty of an offence and is subject to imprisonment for 20 years.

Section 3
a) A person who commits an offence under section 1 or 2,is liable, whether upon summary conviction or upon conviction on indictment, to imprisonment. Such person shall also be adjudged forever incapable of being elected or appointed as a member of a public body or of holding any other public office and shall forfeit any such office held by him at the time of his/her conviction

Section 4
a) Corporation(s) hailing from foreign nations who commit offences under sections 1 or 2, are liable, whether upon summary conviction or upon conviction on indictment, to imprisonment. Said Corporation(s) shall be adjudged forever incapable of operating within Luthori and upon further investigation are subject to be sue for reparations, thus establishing a sue cap of 10 billion pounds.

Section 5
b) Corporation(s) hailing from Luthori who commit offences under section 1 and/or 2, are liable, whether upon summary conviction or upon conviction on indictment. Said Corporation(s) shall be adjudged forever incapable of operating within Luthori. Owners of the Corporations, upon further investigation shall also be adjudged forever incapable of being elected or appointed as a member of a public body or of holding any other public office and shall forfeit any such office held by him at the time of his/her conviction.

*This legislation is a normal law and as such it can be amended and/or abolished with an absolute majority by the Imperial Diet..

MessageWe agree strongly that corruption must be rooted out and punished, however sentencing guidelines should be determined by an independent body, not by politicians. It is imperative that in all legal cases judges make a just decision in the light of the particular circumstances of the case and having heard arguments from both sides.

The clauses mandating 20 year custodial sentences mean we cannot support the proposal.

If the New Conservative Party are serious about tackling corruption we would advise that they bring forward legislation to end political donations and to end the awarding and privileges of nobility, two areas open to malfeasance.

MessageMr. Speaker,

It is clear that the gentlemen from the Worker's Committee has not understood the legislation in its entirety, so i will allow the gentlemen to read the legislation's provisions once more and understand the interpretation made. Where he says that judges must make a just decision in light of particular circumstance, It does not hinder the judge's ability to listen to sides of the argument. The end result, if it becomes clear to the judge that evidence points to the fact that an individual had indulged in corruption activities, he/she will be sentenced to 20 years imprisonment. This is forced as it is clear that corruption is even within our legal system and that is something that the Worker's Committee cannot deny. All it takes is for a judge to ignore Conflict of Interest regulations and provide a minimal sentence (1, 2 or 3 years) for his/her companion. If we cannot trust our own legal system to be transparent and just, how could we expect it to uphold the principles of fair judgement?

MessageIt is rather worrying that a party seeking judicial reform does not understand how the justice system works. Sentencing, which is what we are discussing not the trial, is based on a number of factors including the evidence presented during the course of a trial (previous convictions, age, a guilty or not guilty plea). The reform removes judicial independence and discretion from sentencing.

No, it is not 'clear that corruption is even within our legal system' and creating straw man arguments to justify curtailing judicial independence shall not silence opposition.

As for the "gentlemen" remarks, I think I shall let that rude behaviour speak for itself.
