Bill: Iudicum Maximum: Candidates
Details
Submitted by[?]: Clara Aurora - COSIRA
Status[?]: passed
Votes: This bill is a resolution. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.
Voting deadline: April 4401
Description[?]:
After the designated period, those are the candidates submitted: -Genzius Tuccius. Since 4375 he has acquired extensive experience as a criminal judge, where he has strictly upheld the law of the land. He is responsible for two instances when the offender was sentenced to the death penalty, once in 4376 and once in 4381, just before the abolition of capital punishment. Justice Tuccius continues to subscribes to legal realism, believing that value-free empirical science should serve as the model of judicial rulings, and that law is a practical tool for advancing society's welfare. In his rulings Justice Tuccius tends to emphasize that the purpose of the law is the deterrence of undesirable social consequences, using considerations of fairness and public policy, but devoid of both abstract idealism and textual formalism. He is known to judge more strictly and impose higher punishments when the defendant is wealthier, as a way of setting an example, but he also often imparts the maximum penalties for anti-social behavior like vandalism, loitering, or littering, given that he largely subscribes to the broken window theory. On social issues he is largely of the conservative tradition, but he tends to temper his personal ideological views with his belief that the social consequences of each ruling must be taken into account. As such he has often adopted a more progressive stance on issues such as domestic abuse, abortion, religion, unequal employment, and discrimination. - Albanus Claudius Midius Lawyer Has served two terms in the Senate - Atia Fredisia Lawyer and Canon Lawyer General Counsel to the Factio Aurorianus and Former Executive Director of the Selucians for Religion activist group. Now, the period of debate and voting shall start. Remember the rules: The Senate shall vote to approve the candidature or not. At least 2/3 of the Selucian parties (3 parties) and 2/3 of the Senators (500 votes) shall vote. A candidate will pass if a single majority is achieved, and will fail in the opposite scenario. If it fails, there is no second chance and Article 99 is immediately activated, which indicates that "if after all the candidates presented have been proposed to the Senate and no one has won the vote of confidence, the members of the Supreme Court shall be given the authority to elect a candidate by themselves". If the Iudicum Maximum refuses to do so, another second voting will be celebrated. We hope parties can come with a consensus. Caprenia Belletor, Minister Iustitia |

Message | Senators, I come before you today as the Factio Aurorianus Candidate for Iudicum Maximum. While I have no experience on the bench nor in the Senate I have extensive experience in litigation both in the Aurorian Patriarchal Church and in the Civil Courts of Selucia. After finishing my degree I taught courses in Law and Religion and in Legal Ethics to Law Students. I wrote over 70 articles on Law and Religion where I analyzed the Cases before the Iudicum Maximum and other inferior courts that expounded upon the rights of religious Selucians and the rights of Religions as organizations. I have also written extensively on abortion and have articulated the rights of the unborn that should be recognized by the Court. I am personally a religious conservative but my jurisprudence aligns with legal realism, but on the pragmatic side. That is, I believe in "playing by the rules" and applying the law in an empirically dispassionate way but I also acknowledge that the law "runs out" and judges are left with applying what they think are the philosophical and ethical principals of those who are affected by the law. After teaching and performing scholarly functions for a number of years I left academia and started the Selucians For Religion Center. At this Center I directed pro-bono litigation for religious organization and Selucians attempting to vindicate their rights in the Courts. I argued eight times before the Iudicum Maximum and many times at inferior appellate courts. At the Center I had 75 attorneys working under me and also directed the Center's Fundraising activities. I left the Center last year to become the General Counsel of the Factio Aurorianus. I have not begun any litigation on their behalf but I have handled their campaign finance and Election Law needs. I am available to answer any more questions if need be. Atia Fredisia |

Message | Senators, Given the turmoil that embroiled this government and the agitations for new elections, we deem that it would be immoral to vote on something so permanent a position. We demand that the Casear table this decision until the next election. Fr. Ambrose |
