This bill changes the policy in that it allows commercial surrogacy so that gestational carriers may be compensated for their year-long commitment to couples who want to have children. The bill would: - require all commercial surrogates to negotiate contracts ahead of time and register those contracts with relevant local authorities, preventing disputes about reimbursement that may arise from altruistic surrogacy. - limit the number of successful pregnancies (not babies as triplets and twins are more common in surrogacies) per surrogate to three to prevent "baby farming". Going over the limit shall result in a fine equal to 1.5 times the value of the compensation of the contract that resulted in the surrogate going over the limit. There shall be no limit to the number of gestational carrier pregnancies. The goal of this bill is to make it easier for couples who are infertile to achieve the families of their dreams, while also allowing the women who are willing to help such couples earn decent compensation. |

Message | Mr. Speaker, We agree that people should of course be eligible for receiving monetary rewards for something as burdensome and personal as pregnancy. However why limit compensation? Let the amount of compensation be between the breeder and buyer. Motherhood should be classified as an occupation just like any other and be eligible to determine their own compensation through unions like any other industry. We however do not see any issue with the breeding cap, but what shall be the consequence for going over? We can think of... rather controversial consequences, but maybe just place a cap on the amount of commercial surrogacies to prevent "baby farmers" and reductions to genetic diversity. Message | Mr. Speaker, As stated before, our previous comments were not towards gestational surrogacy, only traditional surrogacy. One does not use the genes of the mother, the other (traditional) does by utilizing natural or artificial insemination. Hypothetically if a significant number of people make a career out of traditional surrogacy, they may cause a decline in diversity in the gene pool depending on the amount of children they have. It would have to be a considerable number however given our present population. We do not have sufficient data to specify whether or not a cap on traditional surrogacy would be even called for given we are not sure how many couples would pursue or be able to afford surrogacy, and how many women would want to be surrogates themselves. The other problem remains is how far the Hutorian government would be willing to enforce a surrogacy birth cap. The New Liberals should remember that this is not our proposal. Eugenics (non-racial) in our view is a separate issue from surrogacy. The New Liberals should remove the birth cap in the bill and propose a population control policy in a separate bill if desired. Doing so otherwise is likely to distract from the bill's core objective. As per our previous recommendation, we also suggest that the payment cap be removed to allow surrogates to be compensated according to supply and demand.
