Bill of Rights of the Republic of Selucia

An Act to defend and protect the rights and freedoms of Selucian citizens and all those residing on Selucian soil and subject to the laws of the Republic, by recognizing the fundamental rights necessary for the democratic and collective self-government of the Selucian People. With the passing of this Act the Republic recognizes the below rights and freedoms, and the governing bodies of the Republic shall strive to respect and promote these rights in all their rulings. So far as it is possible to do so primary and secondary legislation must be read and interpreted in such a way which is most compatible with the rights and freedoms in this Act, without affecting the validity and enforcement of any incompatible primary legislation or of any incompatible secondary legislation if primary legislation prevents removal of the incompatibility. It is unlawful for any public authority to act in a way incompatible with the rights and freedoms in this Act, with the exception of the Senate or a person exercising functions in connection with proceedings in the Senate. Should any secondary legislation violate the rights and freedoms in this Act the Supreme Court may overturn such legislation, in concordance with the provisions of the Velian Law on the Supreme Court (http://classic.particracy.net/viewbill.php?billid=577354). If any primary legislation, that is legislation issued by the Senate, is incompatible with the rights and freedoms in this Act the Supreme Court is empowered to issue a declaration of incompatibility and the Senate must either amend the legislation in a manner consistent with this Act or reject the Supreme Court's ruling and retain the legislation. Primary legislation shall remain in effect even when a declaration of incompatibility is issued, until it is amended by the Senate. This Act shall take immediate effect with its passage by a two thirds majority in the Senate and may be amended or repealed by a two thirds majority in the legislative.

I. All persons in Selucia are equal in front of the law and are treated equally in equal circumstances. Discrimination on the grounds of religion, belief, political opinion, race, sex, gender, or sexual orientation is not permitted. This right can only be limited by law if there is a reasonable justification for restricting it.

II. All citizens have an equal right to vote and stand for office in the representative bodies of the Republic, subject to limitations and restrictions enacted by law.

III. All citizens have the right to contest decisions adopted by the governing bodies of the Republic, including through formal legal petitions.

IV. Everyone has the right to freely manifest one's religion or belief, either individually or in community with others, without prejudice to one's formal obligations under the law, duties as a citizen, and the rights and freedoms of others. This right may be restricted by law other than in buildings or enclosed spaces.

V. All citizens have the right to free expression in private and in public, including through the use of the press, without prejudice to restrictions and limitations under law. This right does not apply to commercial advertising.

VI. All citizens have the right of assembly, right of association, and right of protest, demonstration, and strike, subject to legal restrictions and limitations in the interest of public health, public order, and public morals. This right does not extend to forced membership of organizations, as determined by law.

VII. Everyone has the right to respect for one's privacy, without prejudice to restrictions laid down by law.

VIII. Expropriation may take place only in the public interest, as determined by law.

IX. With the exception of cases laid down by law, nobody may be deprived of life or liberty.

X. Nulla poena sine lege; no offence may be punished unless it was an offence under the law at the time it was committed, with exceptions for crimes against humanity and war crimes, as determined by law.

XI. It is the responsibility of the Republic to ensure sufficient employment, and everyone has the right to freely choose one's employment, without prejudice to restrictions laid down by law.

XII. The Republic has the responsibility to guarantee the subsistence of the population and an adequate distribution of wealth.

XIII. Everyone has the right to education, health, housing, cultural self-realization, and recreation, within limits under the law.

MessageIn the light of Article IV, we would add something similar to "as long as it does not interfere with one's duties as citizen, and does not threaten the lifes of others", so religion cannot be used as an excuse to omit help or to skip certain jobs or obligations
