Bill: The Pro Life Act of 4451

Details

Submitted by[?]: National Conservative Party

Status[?]: passed

Votes: This is an ordinary bill. It requires more yes votes than no votes. This bill will not pass any sooner than the deadline.

Voting deadline: November 4451

Description[?]:

We hold the right to life as preeminent among all others, so we find it wrong to allow one life be extinguished without even being able to speak against their wrongful murder. But in order to find a good balance between the rights of women to have abortions and the rights of potentially aborted babies to live, we suggest that abortion be only allowed during the first trimester of pregnancy and during medical emergencies.

1) Any non emergency termination of a pregnancy after the first trimester of the pregnancy is hereby prohibited.
2) Any termination of a pregnancy during the second and third trimesters is hereby prohibited by the government of Kalistan unless. An abortion can be given after a patient's physician determines that that the birth would be harmful to the patient.
2a) If the physician deems the pregnancy to be dangerous to the mother, they must make a report to the Ministry of Health.
2b) The operation will be allowed after the Ministry of Health reviews the report and authorizes it.

MessageComrade,

If this bill passes, we have it on good authority that millions of women will riot in the streets. How can the Conservatives countenance taking away rights that belong to the women of Kalistan?

We will fight this bill, and will promise to reverse it as soon as we get the opportunity if it passes. Otherwise, we request the NCP modify this act to make it less restrictive on the rights of women.

MessageWe're willing to compromise, and we will revise this bill to make it less restrictive, but we'd also like to ask our SPoK comrades why do the rights of women to not be responsible adults matter more than the aborted babies' rights to exist?

MessageThis is as far as the NCP is willing to compromise, so we hope our comrades will understand our position and values, as we certainly understand that of SPoK.

We plan to postpone this bill until early 4451.

MessageWe answer by asking our NCP Comrades how it is our responsibility as a government to parternalistically concern ourselves with whether or not adult women are responsible? That seems to be outside of the scope of government. Our job is not to determine choices for women, and forcing a woman to carry an unwanted pregnancy seems like a punishment for irresponsibility, which is not a crime.

We believe that choosing to have an abortion is 1) not a willy nilly decision, but 2) is a responsible choice. And we say to the Conservatives, there is a better way to stop the termination of unwanted pregnancies with the law. If our comrades don't want abortions, they ought not have them. Make it a matter of party faith to avoid abortions. And kick out all Party members who have them or have ever had them. I guarantee it, you will lose half of your women immediately. Because the need for abortion has no party affiliation. Conservative Women and Socialist Women alike need abortion to be safe and they need it to be available, so in case they need it, it is an option.

We should not simply assume that just because the Conservatives have won the last election dramatically, that the people of Kalistan want their rights to plan their families and have safe medical practices taken away.

We fully support moderating this, and while the first trimester is a very short period of time, we hope that the Conservatives will not see that compromise as undue.

The SP will vote no, because we are in favor of the current law, but we thank the Conservative majority for their willingness to admit at least some abortion.

MessageWe're not concerning ourselves wit whether or not our adult women are responsible or not, it's not the job of the government to do so. However, it is the job of the government to ensure the rights and safety of our citizens and all people within our border, including the unborn. We understand that most women just go and have an abortion willy nilly, it takes a lot of thought. We just don't think it's right for women to choose whether or not their child gets to live or die.

In response to your "Conservative Women and Socialist Women alike need abortion to be safe..." statement, we understand the some pregnancies can be dangerous to the mother, that's exactly why this bill has article 2. OOC in the description, there's obviously only one legislative article)

Lastly, since you avoided answering this question, why should women have the right to not give birth, thus denying another human the basic human right to live?

MessageIt has never been established that the rights of citizens extend to the unborn. We do know that rights extend to naturally born citizens (i.e. citizens who are born in Kalistan) and all naturalized citizens. We do know that rights extend to people who are alive. There is nothing in the constitution that people have rights BEFORE they are born. Extending rights would put all kinds of people in legal jeopardy. If I am driving a car, for example, and hit some ice in the mountains, and spin out and kill a person, I am responsible for the accidental death, and I owe restitution. Even if I was doing everything safely. If a mother has a miscarriage, even if she is doing everything safely, will she also be responsible for the accidental death? This is why we do not extend rights to the unborn- They may never be born, even if the mother does everything well.

Our emphasis in the safe and available comment was on the available. They will get abortions, but limiting their availability will force them to be less safe. We are all aware of what happens when abortions are made illegal: Women violate the law. If we refuse to allow doctors to perform them legally, women will get them from butchers. This is also the argument against drug prohibition, by the way. Just because drugs are prohibited somewhere, that doesn't mean that people don't get drugs. If we outlaw abortions for the second trimester, we will just see women in their second trimester getting abortions illegally, and less regulated individuals performing them illegally. The law doesn't stop abortion. So why should we not strive to make it as safe as possible by regulating it?

The answer to the question is provided above: The woman has rights, the unborn do not. The right to live happens after living is an actual fact.
