Whilst we reject the absurd and intrusive stipulation in Article 3 in this bill, we recognise that the necessity for reform in civil society is so great that we are willing to make concessions on this matter. Therefore, the whip shall instruct our Senators to vote in favour of this bill - in spite of our opposition to Article 3 of this bill, which we will furthermore pledge to reverse should this bill pass and should we win the elections later this year.

MessageArticle 3 is specially harming, and shows once again the true face of Factio Republicana, that since a long ago has claimed the defence of LGBT people. Gender identity is not of the incumbence of anyone but the affected person. If you don’t accept somebody because of that, then dont be eith that person at all. To approve the need of consent from the partner is simply an unacceptable law, but serves to show Selucians the true colors of our political parties.

May I suggest some in this house should abandon their attempts at virtue signalling and consider Article 3 again in the context of other laws pertaining to marriage.

We have in place a law which states that divorces are only legal with grounded causes - adultery, or violence, for example.

I believe if a wife suddenly discovers her husband has decided to change his gender identity, she should have some say in this matter specifically in terms of how it effects their future marriage and the vows they have made to one another.

If the married partner cannot give consent to this change then there is now a straightforward legal grounded cause from which either or both parties can proceed towards divorce. This ensures the two are not stuck in a marriage they no longer want and can amicably separate. The current law infers that changing one's gender identity is not necessarily legal grounds for divorce and may mean that any divorce proceedings may become protracted, costly or may never be approved by a court.

I must second Senator Fabianus' remarks regarding gender identity. For one, to claim that it is a purely personal matter betrays a crass ignorance regarding the social nature of gender identity and gender roles. Secondly, although we agree that the government should not force any citizens into a gender identity that does not conform to their internal and individual experience of gender, we also believe that in sexual intimacy the right not to associate trumps the right to associate. Individuals have the moral duty to disclose their gender identity to potential partners, given the tremendous importance most individuals, straight or gay, place on the sex and gender of their partners. This is all the more true for marital intimacy, where, given the intimacy involved, both parties should have the ability to make their own judgement on whether they wish to consent. In less intimate settings, such as at workplace or in public life, the right to not associate does indeed not trump the right to self-definition. But the marital context, due to its intimacy, morally requires consent and involves the right to non-association.
