Background:
Background checks identify individuals who are ineligible to purchase firearms and prevent those persons from obtaining them, making them a key element in preventing tragic and unnecessary gun deaths.

Foundation:
This law requires any prospective purchaser of (or transferee or person being loaned) a firearm to submit an application to purchase the firearm (also known as a “Dealer Record of Sale” or “DROS” form) through a licensed dealer to the justice department. The dealer must submit firearm purchaser information to the Justice Department on the date of the application through.

The purchaser must present “clear evidence” of his or her identity and age to the dealer (or a valid identification card). Dealers must obtain the purchaser’s name, date of birth, and driver’s license or identification number

A mandatory 5 day waiting period will be imposed for the Justice Department to seek further background information. In addition to a mandatory five-day waiting period, the Justice Department must also tell the dealer to delay the transfer of the firearm to the purchaser if Justice Department is unable to determine whether the purchaser is a person who is prohibited from possessing a firearm.

Private Sales: With limited exceptions, all firearm transfers in Kalistan must be conducted through a licensed dealer.

Firearms in Police Custody: Any person claiming title to any firearm in the custody or control of a court or law enforcement agency who wishes to have the firearm returned must undergo a background check to determine if he or she is eligible to possess a firearm.

Voluntary Background Checks: Any person may request a voluntary determination, called a “firearms eligibility check,” from the Justice Department, stating whether he or she is eligible to possess a firearm.

MessageThis is no restriction whatsoever. This bill is designed in order to ensure that all gun owners have no “red lines” in there backgrounds or strong indicators which would show that they could be a threat to the public, if they had such a weapon. I would think that to ensure the safety of all citizens, we would include the five-day waiting period for the justice department to further investigate. To call this a restriction is an outright travesty. Once the individual passes the background check, they can absolutely use it for hunting, sporting, or for defense.

MessageWe disagree that it is a travesty to call it a restriction. In fact, the bill is designed to prevent people from freely obtaining weaponry. But as you know, those bent on criminality are not interested in the law. This law only prevents law abiding individuals from acquiring firearms legally. What does a mandatory 5 day waiting period accomplish? When the police seize weaponry, it is up to the police to decide whether to return it? Why would we trust the police to do the correct thing in this case?

We see this not as a restriction so much as a unjustified government intrusion into the lives and activities of citizens, and we oppose that.

MessageThe police aren’t seizing any weapons unless the individual is arrested or is found to have violated some sort of bond. The mandatory 5 day waiting period is established to further seek background information, in case there happens to be something that the Justice Department is unable to acquire. Again, the police won’t be taking any weapons unless one is incarcerated and rightfully so. Of course there is distrust with the police, the purpose of this bill is to ensure safety within our communities and not to remove guns from legal holders. Must I reiterate, to consider this a restriction is a poor misrepresentation of the facts. Protection not a restriction.

MessageSo,We will vet people and create a database of personal information and decide who gets to own a weapon ? Do we vet the massively armed police/military officers in the same way ? This is a pure example of big government and our stance on that is simple:
A Government that is big enough to ensure/control/check everything is big enough to take everything away !

MessageThere is either a clear misunderstanding or just a flat out education issue. No personal information will be stored in a database system. A criminal record is public information. Perhaps, the LDP should focus on keeping funds in our education system so that you can very well comprehend the purpose of a database and this bill.

MessageIts neither,its actually the fact that you are manipulating and moving around the truth,To determine if someone is allowed or not to own a gun you would need to send every single Gun owners personal information to the justice department so they can “determine” if you deserve to own a gun,so either you are trying to manipulate and lie to this Parliament or you simply do not know how bureauacracy works which proves our case that the education system sucks
