WHEREAS certain rights are intrinsic to all human beings; AND WHEREAS the Kundrati Union is a nation founded on the principles of universality, meaningful equality and fundamental justice; THEREFORE the following rights shall inform all laws and government action within the Kundrati Union: I. No person shall suffer discrimination or marginalization based on the grounds of that person's (a) sex (b) sexual orientation (c) political belief (d) religious belief or practice (e) national, social or ethnic origin (f) family status (g) marital status (h) source of income (i) property (j) disability (k) age II. The aforementioned rights shall be interpreted as applying, where appropriate, to classes of persons sharing these grounds, and the law shall be equally applied so as to address systemic discrimination. III. These protections shall extend to all persons in the areas of (a) employment and labour (b) housing (c) public expression and the media (d) access to and the provision of justice (e) education (f) the necessities of life (g) opportunity IV. (a) All persons are equal before the law, and shall enjoy equality of outcome under the law. (b) Organizations not operated for profit, whose primary purpose is the amelioration of discrimination as defined within this Code, shall not be found in contravention of the Code for granting preference to historically disadvantaged persons or groups, unless it can be demonstrated that such preference substantially and significantly offends the public interest. V. The Kundrati Human Rights Code guarantees these rights subject only to such exceptional limits prescribed by law as can be demonstrably justified in a free and democratic society. |
