Galerian Law on Impeachment

As the current impeachment procedures are designed with the defunct Rectoral system in mind, it becomes necessary to update our constitutional arrangements to ensure that the Magistrates can be held accountable.

Article I. The Indran Law on Impeachment (http://classic.particracy.net/viewbill.php?billid=590021) is repealed.

Article II. As determined by the Mummian Law on the Senate and Censor (http://classic.particracy.net/viewbill.php?billid=630030), the Censor cannot be impeached or otherwise removed from office. The People's Assembly may however initiate early elections, including Censoral elections.

Article III. "Impeachment" shall be defined as the decision by which the chamber of representation of the people of Selucia, the legislative branch, withdraws its trust in the representatives of the executive power.

Article IV. Impeachment can only be initiated by a Tribune (http://classic.particracy.net/viewbill.php?billid=630037), and will require the approval of an absolute majority in the People's Assembly.

Article V. An impeachment may be filed against any of the following magistrates: Consuls, Praetors, Aediles, and Quaestors. Impeachment can only be filed against one or both Consuls or only one of the lower magistrates by the same Tribune.

Article VI. If the impeachment fails, the same Tribune shall not be allowed to introduce another one in the period of one year, without affecting the possibility that other Tribunes may present another one under the same established conditions.

Article VII. If the presented impeachment is approved, the affected magistrate is required to leave all their functions within a maximum period of 5 days, and the People's Assembly shall appoint a new magistrate. The magistrate who has suffered the impeachment shall not be able to return to the post until the next legislative cycle.

OOC: This is a constitutional RP Law, as governed by Section 6 article 5 of the Game Rules (http://forum.particracy.net/viewtopic.php?f=5&t=8088). This bill introduces the ability of the legislative to proceed with an impeachment against individual members of the Cabinet of Selucia. It requires half of the legislature to vote in favour.
