The Act respecting the Separation of the Provincial and Federal Court System. This Act may be cited as the Judiciary Federalism Act. Article 1) Provincial and Federal Courts 1.1 All cases that fall under the purview of provincial law will only be ruled over by provincial courts and cases that fall under the purview of federal law will only be ruled over by federal courts. 1.2 All provinces will establish a supreme court that will be the final appellate court for court cases involving provincial law in that province. 1.2.1 The provincial supreme courts will comprise nine (9) judges appointed for a non-renewable, 12-year term. 1.2.2 Once a seat is vacant on a provincial supreme court, a judge must be appointed by an independent commission. 1.3 The federal supreme court can hear appeals if the appeal is based on federal law even if the original case is based completely on provincial law. |
