Title: Advertising Standards Act

Purpose: To regulate advertising by setting certain standards to ensure that advertisements are truthful, accurate and not misleading.

Section 1: Definitions

(a) Advertisement - any form of communication which is intended to promote or sell a product or service.

(b) Advertiser - any person or organization that engages in advertising.

Section 2: Advertising Standards

(a) All advertisements must be truthful, accurate and not misleading.

(b) All advertisements must comply with any relevant laws or regulations.

(c) All advertisements must be clearly distinguishable as such.

(d) Advertisements must not be likely to cause harm or offence to members of the public.

(e) Advertisements must not contain any material that is likely to encourage unlawful behaviour.

Section 3: Advertising Content

(a) Advertisements must not contain any false or misleading claims about the product or service being advertised.

(b) Advertisements must not make claims that cannot be substantiated.

(c) Advertisements must not exploit the fears or anxieties of consumers.

(d) Advertisements must not imply that the product or service being advertised has qualities that it does not have.

(e) Advertisements must not use images or language that is likely to be offensive or discriminatory.

Section 4: Enforcement

(a) The Advertising Standards Authority (ASA) shall be responsible for enforcing this Act.

(b) The ASA may investigate complaints about advertisements and take appropriate action if the advertisement is found to be in breach of the standards set out in this Act.

(c) The ASA may require advertisers to withdraw or amend advertisements that breach the standards set out in this Act.

(d) The ASA may impose fines on advertisers that breach the standards set out in this Act.

Section 5: Penalties

(a) Any person or organization found to be in breach of this Act may be fined up to LPD 500,000.

(b) If a breach of this Act is found to be deliberate or reckless, the fine may be increased to up to LPD 1,000,000.

Section 6: Commencement

(a) This Act comes into force on the 1st of January 5295.

(b) This Act extends to Shipleyriding, Middenriding, Northriding, Erneshire and Orange.
