𝐅𝐮𝐥𝐥 𝐓𝐢𝐭𝐥𝐞

An Act to establish the formal institutions that local governance in the Empire could finally be run on the law instead of the custom.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟏 - Any previous Act of the Imperial Diet about second-level administrative divisions is repealed upon the passage of the Act.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟐, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟏 - A "county" is a subunit of duchies that is also the third level of the government in the nation (central government is the first and regional governments are the second level, so third).

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐 - The list of counties are (for each duchy):

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟑 - The ducal capital is the city where the seat of the ducal government is located, and the county which corresponds to that shall be given more funding in order to manage the governance, as its governance requires more effort compared to the other counties due to the ducal capital being located.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟒 - Fort William, due to it being both the ducal capital of Orange and the national capital as many of the important state institutions (Imperial Diet, Constitutional Court etc.) as well as the state institutions of the duchy of Orange (ducal diet, ducal courts etc.), shall be given the most special status among counties.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟓 - The funding of the counties shall be the joint responsibility of the counties themselves, duchies, and the national government.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟑, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟏 - The deliberative assembly of counties shall be known as the "county assembly" and they shall be elected through a direct election which is to be held each five years. Each county assembly shall have 50 members, and the members of the county assemblies shall be elected through party-list proportional representation.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐 - The county assemblies shall have the power of legislative initiative as well as passing bills in the bounds of the constitutional provisions, ducal and national laws regulating the powers of counties.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟑 - Most of the projects initiated by the Mayor, unless they are considered relatively small in spending (15% or less of the county funding), shall be subject to the approval or dismissal of the county assembly. In case of no action taken by the assembly, approval shall be assumed.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟒, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟏 - The executive power of the counties shall be held by the Mayor, who is to be elected through a first-past-the-post election that the highest-ranking candidate in the list wins the elections. Those elections are to be held within 5 years, simulateounsly with the ones for ducal diets and county assemblies.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐 - As the mayoral elections are held based on the first-past-the-post, the candidate does not have to get 50% or more of the votes in order to be elected, being the highest-ranking one at the candidates list is enough.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟑 - The Mayor, as the person who holds the executive power in the county level, shall have the power to initiate county-level projects (but some of them could require also the approval of the county assembly, or in case that they really get huge, the ducal diet) work with the ducal and national governments on big projects, and in overall exercise the executive actions at a county level.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟓, 𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟏 - The judicial power in the counties shall be held by the county courts, with mainly two courts being there, the Criminal and Civil Court. The Criminal Court shall have the responsibility of criminal trials while the Civil Court is responsible for civil trials. The county courts are authorized to judge on basis of county, ducal, and national laws.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟐 - The members of the County Criminal and Civil Courts shall be appointed by an independent commission, and each of those courts shall have 5 justices in total. The commission that is authorized to appoint the judges into county courts shall comprise legeal experts such as magistrates, lawyers.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟑 - The County Appellate Court, which is the highest court at the county level, shall hear appeals from the Criminal and Civil Courts as well as reviewing the acts/actions by the Mayor or the county assembly, and it is placed on the highest hierarchy at the county judiciary. The Appellate Court rulings shall be binding on the Criminal and Civil Court.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟒 - The members of the County Appellate Court shall be appointed on advice of the county assembly, the motion that creates the judges list must be approved by 4/5 of the county assembly (38 out of 50 seats), and then this list shall be subject to the approval of an independent commission. Each of the County Appellate Courts shall have 7 members in total.

𝐏𝐚𝐫𝐚𝐠𝐫𝐚𝐩𝐡 𝟓 - The decisions of the County Appellate Court could be further appealed to the ducal courts, up to the Ducal Supreme Court, and in cases that involve the disputes over the interpretation of the national law or the constitutional provisions, the national Supreme or the Constitutional Court.


𝐀𝐫𝐭𝐢𝐜𝐥𝐞 𝟔 - This is a constitutional law and requires 2/3 seats of the Imperial Diet to pass and be amended, and 1/2 + 1 seats of the Diet to be repealed.
