OOC: I wanted to put a copy of the constitution that passed in 5167 (http://classic.particracy.net/viewbill.php?billid=677725) just so all new players can see it SECTION I: RESTORATION OF THE FEDERAL REPUBLIC OF HUTORI Article 1) The country formally known as the ‘’Commonwealth of Hutori’’ shall now be identify as the ‘’Federal Republic of Hutori’’ SECTION II: EXCUTIVE POWER OF THE FEDERAL REPUBLIC OF HUTORI Article 1) The executive power of the federal government of the Federal Republic of Hutori shall be held by the President, the Prime Minister and the Cabinet Members according to the Chart of Executive Power SECTION III: RESTORATION OF THE SENATE Article 1) The National Senate of Hutori shall be restore Article 2) The legislative power of the federal government the Federal Republic of Hutori shall be held by the National Senate of Hutori Article 3) The senate shall be composed of the 305 elected senators and shall keep the same constituency as the former House of Parliament SECTION IV: ABOLITION OF MONARCHY Article 1) The Federal Republic of Hutori shall not recognize any individual as being the monarch of Hutori. Article 2) The Federal Republic of Hutori shall not recognize any family as being the official royal family of Hutori. SECTION V: POLICY CONTINUITY Article 1) All policies, laws, regulations and treaty ratification currently implemented within the country known as the ''Commonwealth of Hutori'' shall be maintained in the ''‘’Federal Republic of Hutori'' until further modication by the rightful authority of federal governement. Article 2) All laws and policies concerning directly the conditions of both the monarch or the royal families shall be exempted from the Article 1 Section V and be automaticly removed as soon as this bill comes into law. SECTION VI: DATE OF APPLICATION Article 1) All article in this bill shall only come into law after the first election following the passage of this bill by the House of Parliament. ====================================================================================================== A copie of the ''Chart of Executive Power'': Section 1) The President Article 1) The President has the right to appoint Justices to the Supreme Court when one of the existing Justices is found either incompetent or has deceased. This appointment must be approved by a majority of the Senate. Article 2) The President is to act as the Commander in Chief of the Hutorian Military. Article 3) The President conduct International Relations with the help of the Prime Minister and the appropriate ministers Article 4) The President's duty is to dictate the policy of the state to the Prime Minister and instruct them as to how to conduct it Article 5) Only the President has the power to appoint a Prime Minister or a cabinet member, all his or her nomination will require a majority vote from the Senate Article 6) Any member of the Senate may initiate a vote of non-confidence of the President. A two-third majority vote from all the senators will be require for a motion of non-confidence to be accepted. The President will be remove from office as soon as the necessary vote are obtained. Section 2) The Prime Minister Article 1) The Prime Minister serves as the chair of the cabinet, as the head of government and is the next in the line for presidential succession. Article 2) The members of the cabinet answer to the Prime Minister and must carry out his or her orders Article 3) The duty of the Prime Minister is to conduct the policy of the state as instructed by the President Section 3) The Cabinet and Line of Succession Article 1) The cabinet members may be required to submit reports on their Ministry's progress at the Prime Minister's leisure. Article 2) The aforementioned reports can include but, are not limited to Intelligence, Financial and Action Reports. Article 3) The Prime Minister may dismiss a member of the cabinet with sufficient cause and Presidential approval. However, likewise the President must receive approval from the Prime Minister before dismissing a cabinet member. Article 4) Each cabinet member serve as the highest official of their respective ministry and dictate the policy of their ministry in accordance with the Prime Minister's orders Article 5) The line of succession for the presidency is as follows: the Prime Minister, the Foreign Affairs Minster, the Internal Affairs Minster, the Defense Minister, the Minister of Justice, the Finance Minister, the Speaker of the Senate, the Minister of Trade and Industry, the Minister of Science and Technology, the Minister of Education and Culture, the Minister of Food and Agriculture, the Minister of Health and Social Services, the Minister of Infrastructure and Transport and then the Minister of Environment and Tourism. Section 4) The Deputy Prime Minister Article 1) During the formation of a cabinet, a minister shall be designated as the Deputy Prime Minister. Article 2) If no minister is directly designated as deputy Prime Minister in the bill creating the cabinet, the minister of Foreign Affairs shall automatically assume the role of deputy Prime Minister Article 3) If the deputy Prime Minister resign from their position, the Prime Minister can name any other minister as Deputy Prime Minister with the approval of the President Article 4) The primary role of the Deputy Prime Minister shall be to assist the Prime Minister in their task Article 5) In case of absence of the Prime Minister, the Deputy Prime Minister can temporarily take the role of Prime Minister with the prior agreement of the Prime Minister Article 6) If the office of Prime Minister is left vacant or the Prime Minister is deemed no longer fit to serve, the Deputy Prime Minister shall take on the role of Prime Minister. Section 5) Ministerial Vacancy Article 1) If one position in the cabinet is left vacant, the President will have the power to name an interim minister to fill that position with the approval of no less than 75% of the still active cabinet members Article 2) If both the position of Prime Minister and the position of Deputy Prime Minister are left vacant, the President shall have the power to name an interim Prime Minister with the unanimous approval of the still active cabinet members Article 3) Interim ministers or Prime Ministers shall only have the capacity to serve for a period not exceeding 6 months, after what the position shall remain vacant until the National Senate can form a new cabinet. Article 4) If every position in the cabinet is left vacant, the President shall have the power to fill every cabinet position with interim ministers and an interim Prime Minister without further approval |
