LEGISLATION DESCRIPTION:

The following legislation serves as a renegotiation of the Crown Dependency Treaty and the establishment of a Suttonite Government. The bill establishes a new government structure in Sutton and gives Sutton more independence and power over its own affairs. It removes the monetary responsibility of the Government of the Commonwealth for the budgetary health of the Crown Dependency. The Crown Dependency will therefore be able to sink or swim on its own.

LEGISLATIVE TEXT:

Recognizing the Isle of Sutton as a Crown Dependency of the Hutorian Crown, the people of Sutton and of the Commonwealth of Hutori do establish and ordain this CONSTITUTION OF THE CROWN DEPENDENCY AND PRINCIPALITY OF SUTTON

Article I: The Crown Dependency and Constitutional Principality of the Isle of Sutton, heretofore referred to as “The Isle”, shall recognize the heir to the throne of the Commonwealth of Hutori, heretofore referred to as “The Commonwealth”, as the head of state of The Isle. The head of state shall choose the title “Prince” or “Princess” and shall be provided an official residence in Sutton City.

Article II: The Commonwealth will be responsible for the provision of the common defense for The Isle. Therefore, any legislation passed concerning the military defense of The Commonwealth applies also to The Isle. Should the Isle be attacked from without or from within, it is the duty of the The Commonwealth to come to her aid. In return for the provision of defense, the Isle shall allow the Commonwealth to build military bases and other installations on the Isle. The Government of the Isle shall set aside 10 percent of the Isle’s natural land for the use of the Commonwealth armed forces. The Isle may maintain, for its own self-defense, a maritime service to perform the functions of a navy or coast guard, not to exceed one-fifth the total of ships maintained by the Commonwealth military. All the restrictions on the procurement of ordinance in the Commonwealth apply to the Principality. In times of war, the Suttonite forces will fall under the leadership and purview of the military of the Commonwealth.

Article III: The Isle will be responsible for conducting international relations on its own behalf, but all treaties to which the Isle wants to become a signatory must be approved by the Commonwealth. Any international treaty signed by the government of the Commonwealth will also refer to the Isle.

Article IV: The Isle is responsible for the formation of its own budget to be decided by the government of the Isle as described below.

Article V: The Head of State of the Isle
Section 1: The Head of State shall serve as a visible symbol of the connection between the Isle and the Commonwealth.
Section 2: When the Head of State ascends to the Throne of the Commonwealth, he or she no longer serves as Head of State of The Isle. The heir to the Throne of the Commonwealth immediately becomes the Head of State to The Isle.
Section 3: The Head of State must spend at least 100 days per annum resident in The Isle, unless offered a special dispensation from the government of the Commonwealth.

Article VI: The Head of Government and Chief Legislator of the Isle
Section 1: The President of the Crown Dependency shall be elected by a simple majority vote of the people of the Isle of Sutton at intervals that coincide with elections in the Commonwealth.
Section 2: The President shall serve as the chief executive of the Isle, and shall be responsible for law-making, day-to-day governance, and engaging in foreign relations on behalf of the Isle.
Section 3: As a unitary leader, the President faces three checks on his or her power.
- Subsection A: The people of the Isle may elect a new President in an election.
- Subsection B: The Parliament of the Commonwealth or its successor may choose by a 2/3rds majority to amend the Constitution of the Crown Dependency, thereby removing the office.
- Subsection C: The Head of State may ask the President to step down, or may ask Parliament to amend the Constitution of the Crown Dependency.
Section 4: The People of Sutton shall be represented by the President in bilateral relations with the Commonwealth, but will no longer have legislative representation in Parliament or its successors.
Section 5: The President of Sutton will appoint a government of ministers to serve as a cabinet and carry out the functions of executive leadership.

Article VII: The Crown Court.
Section 1: The Crown Court will serve as the chief judiciary body for the Isle.
Section 2: The Crown Court will consist of no fewer than 3 and no more than 7 judges appointed to lifetime appointments by decree of the President.
Section 3: The Crown Court shall have the power of judicial review with respect to the decisions of the President. Should a new law enacted by the President be found to be unconstitutional, or in violation of Commonwealth laws, that law shall not go into effect.

Article VIII: The laws and criminal code of the Commonwealth shall be respected and adhered to by the government of the Isle. Any act made illegal in the Commonwealth shall also be made illegal on the Isle. The Government of the Isle is responsible for managing a police service to investigate crimes and a Crown prosecutorial service to prosecute those accused of crimes. The Crown Court or appointed agents of the court will serve as judges for crimes committed in Sutton.

Article IX: The right of the Suttonite people to determine their own tax rate should not be infringed by the government of the Commonwealth.
Section 1: The Government of Sutton may institute a personal income tax not exceeding 50 percent on the highest tax bracket, and the minimum annual income threshold for paying tax shall be 25,000 HLR.
Section 2: The Government of Sutton may institute a business income tax not exceeding 25 percent, or the business tax rate of the Commonwealth whichever tax is lower.
Section 3: The Government of Sutton may institute consumption taxes on goods and services at a rate no higher than 10 percent.
Section 4: The Government of Sutton may institute luxury taxes on goods and services deemed luxuries by decree of the President at a rate no higher than 50 percent, or the luxury tax rate of the Commonwealth whichever tax is lower.
Section 5: Should the President deem a tax not mentioned above is necessary for the general welfare of the Isle, any requested taxes must be approved by a 2/3rds vote of the Parliament of the Commonwealth.

Article X: Should the Commonwealth of Hutori cease to exist, it will be within the purview of its successor state to determine the status of its relationship with the Isle. Should no successor state exist that honors the royal family of Stewart-Carmichael as heirs to the throne of Hutori, the Isle may lay claim to be the successor state of the Commonwealth of Hutori as the “Constitutional Principality of Sutton and Government of the Commonwealth of Hutori in Exile” should it vote to do so by plebiscite with a 3/5ths Majority.

Article XI: Upon passage of this constitution, the President of the Isle and his or her associated government will consult the people of Sutton on the creation of new symbols including but not limited to a state seal, state flag, and coat of arms of the head of state. Symbols must be approved by simple majority vote of the Parliament of the Commonwealth.

Article XII: The responsibility for provision of the following services will fall under the purview of the government of the Isle:
Section 1: The provision of the general welfare and health of all Suttonite people, and,
Section 2: The general education from elementary through tertiary education, and,
Section 3: The pensions of civil service workers, and,
Section 4: The building and upkeep of modes of transportation on and to the Isle, and
Section 5: Other areas of policy and public provision not listed here and not undertaken by the Parliament of the Commonwealth

Article XIII: The rights enjoyed by the people of the Commonwealth and the Mashacara Indigenous People shall be enjoyed by the Suttonite People.

While we wait for the cabinet to be sorted, the SNP-Labour Coalition is proud to bring forth the negotiated new constitution of Sutton for a vote from Parliament. We worked hard with Hutori First, and specifically the Prime Minister and his team to put together a proposal we think does the following:

- Reduces the tax burden and balances the budget for Hutori, while giving budgetary freedom to Sutton
- Strengthens the role of the Monarch by establishing the Heir Apparent as Prince or Princess of the Crown Dependency and Constitutional Principality of Sutton, and allowing for Sutton to be the successor state to the Commonwealth should the Commonwealth ever become a Republic or choose some other government
- Allows the Commonwealth military to focus on defending the Commonwealth instead of defending Sutton, as Sutton will be empowered to manage its own defenses.
- Gives Sutton the power of taxation within Constitutionally defined limits not to exceed 15 percent in even the highest of income tax brackets.

As I noted in the interview, this will be a two-step process. First, the re-establishment of the Crown Dependency will require the passage of this Constitution. After it is passed, the Foreign Minister of Hutori or President of Sutton will craft a new treaty to govern international relations for Sutton, that must be approved by the Commonwealth Parliament.

I look forward to this vote, as ensuring the independence of Sutton has been my life's work. I cannot thank the member for Glentingham East enough for his careful consideration and assistance in this matter.

We beg our friends in the National Party, People's Party, and Liberal Party to reconsider. With the passage of the new budget act, Sutton will be without any governmental income if you don't vote for this bill!

Sutton having its own defense forces is not threat to Hutori! In fact, in times of war, the Sutton Maritime Service will fall under the direct command of the Commonwealth Armed Forces!

All monarchist parties should love this bill. It effectively ensures that the Monarchy lives on even if the Commonwealth becomes a Republic. Please support this bill!

The Nationals cannot back for the reasons previously stated. Additionally we do not see why a nationwide vote is the best method of to elect a President of the Crown Dependency (ooc. Perhaps a RPd election of a President of the Crown Dependancy using party vote totals for that region would be better?)

We urge the other unionist party's to stand firm, do not give in to separatism, do not give in to Sutton having its own armed forces. Hutori must remain united. The parties that favour this proposal suffered losses at the last election, the people have spoken!

MessageOOC: For RP reasons, the "nationwide" vote for the President would really happen in Sutton. The goal here is to create a "country within a country." Because the game mechanics allow only a HoS and the Foreign Minister to write treaties, this is the only way to make it so that Sutton can set up its own foreign policy.

MessageOoc: Understood, although it isn't a great method as presumably the SNP will have local strength in Sutton but could never be gaurenteed to win the HOS elections so you could end up with, for example, a Nationals Party HOS with no desire to legislate for Sutton. You'd be better off coming to an informal agreement with other pro-Sutton separatist parties to share the Foreign ministry positions.

MessageOOC: Once Sutton is its own country, there is no reason for the SNP to exist. The party will just fold into other existing parties. Once it is done, I'll be moving most of my main characters to Labour full-time. The goal is to create a "fourth rail" of Hutorian politics (considering that the status of the Monarchy is a "third rail"). Forces every party to take a stance on Monarchy and Union.

In order to kick start continued talks on this subject which propose that as a starting point the nationwide election for the President of the Crown Dependancy is scrapped in favour of a localised vote (ooc: RP'd based on parties regional share of the vote, this would also scrap Articles One and Two). Additionally we see no requirement for Sutton to have a seperatel armed forces.
