Organ Procurement and Exchange Network for Transplantation (OPEN for Transplantation)

This International Treaty seeks to set standards amongst nations to allow for international registry and legal transfer of organs for transplantation.

Signatories to this treaty agree to the following articles:

Article 1) see active article below regarding national law on organ donation;

Article 2) each signatory nation will set up a local (either national or regional) OPEN body that will administrate the work of this Network within their nation; to be referred to in this document as Local OPEN;

Article 3) all in-hospital deaths (both cardiac and neurologic) must be reported to the Local OPEN office which will assess suitability of organs for transplantation and if deemed suitable will begin the process of obtaining consent and managing the organ donor;

Article 4) organs available will be allocated within their region (i.e. province/state) of origin first. If no suitable organ recipient is identified within the region of origin of the available donor organ, this organ will be allocated within a geographic area of 300km radius (regardless of national/regional borders) to recipients based on an algorhythm of disease severity; if no suitable organ recipient is found within the 300 km radius of the organ donor hospital, similar allocation attempts will be made using progressive 300 km-wide rings centred on the organ donor hospital;

Article 5) an international computerized database will be maintained and updated that will list potential organ recipients, the organ(s) needed and the location of their transplant hospital. This database will be used to expedite the allocation of organs by need and location;

Article 6) each signatory nation will send one member to sit on the Board of Directors of OPEN; this board will determine day-to-day policy of the Network and will be empowered to set subcommittees (organ specific, ethics, quality improvement, etc.) to deal with issues of necessity to the Network;

Article 7) the Network will function as a not-for-profit entity. Board of Directors members will be remunerated by their own nations. The cost of the Network, employees, coordinators, capital costs, etc. will be paid for by a fee set for each organ retrieved for transplant and paid for by the retrieving hospital;

Article 8) the Network will have its International Headquarters in Eveari, Ananto, in the Federal Republic of Kalistan. "OPEN House" is a large facility/office building built by and paid for by the Kalistani National Government - its rent will be nominally 1 Kalistan Dollar/year in perpetuity - this rental agreement will only be rescinded should there be less than 2 member nations for a period of more than 50 years.
